Special Meeting August 31, 2006 Page 2 Mayor Narvaiz introduced a public hearing regarding an Annexation Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 50.237 ACRES, MORE OR LESS, LOCATED IN THE 2600 BLOCK OF POST ROAD (HILLBURN TRACT) ; APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. I Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Narvaiz closed the public hearing. Mayor Narvaiz introduced for consideration approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PARTIAL RELEASE OF A WATER LINE EASEMENT LOCATED IN A 495 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED NEAR THE INTERSECTION OF CENTERPOINT ROAD AND OLD BASTROP ROAD; APPROVING THE RELEASE OF A TAX ABATEMENT AGREEMENT WITH APACHE HILLS, LLP., RELATED TO THIS PROPERTY; AUTHORIZING THE CITY MANAGER TO EXECUTE RELEASES; AND PROVIDING AN EFFECTIVE DATE. Mr. Jones moved for approval of an Ordinance on second reading, and Mr. I Bose seconded the motion, which passed unanimously. Mayor Narvaiz introduced an Executive Session pursuant to the Government Code, Sections 551.071, to seek the City Attorney's advice regarding pending litigation, contemplated litigation, a settlement offer, or a matter involving attorney-client privilege (City Clerk); Section 551.07~, to discuss the evaluation of a public officer or employee (City Clerk); and the duties of a public offer or employee (City Manager). The Council adjourned into Executive Session at 6:06 p.m. Mayor Narvaiz announced the Council would reconvene at 6:45 p.m. Mayor Narvaiz introduced for consideration adoption or direction to Staff on matters discussed in Executive Session. Mr. O'Leary stated the City Council discussed the duties and evaluation of a public officer and provided direction on how to proceed. Mayor Narvaiz introduced for consideration adoption of Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, I APPROVING AN AGREEMENT BETWEEN THE CITY AND JANIS WOMACK; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE.
