<br />I <br /> <br />RESOLUTION 2007- 185 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A LEASE-PURCHASE AGREEMENT AND RELATED <br />INSTRUMENTS BETWEEN THE CITY AND WELLS FARGO FINANCIAL <br />LEASING, INC. TO PROVIDE THE NECESSARY FUNDING FOR THE <br />PURCHASE OF FOUR KONICA MINOLTA COPIER/SCANNERS; <br />APPROVING THE PURCHASE OF THESE COPIER/SCANNERS FROM <br />DAHILL INDUSTRIES THROUGH THE TEXAS LOCAL GOVERNMENT <br />PURCHASING COOPERATIVE BUYBOARD; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE AND DELIVER THE LEASE-PURCHASE <br />AGREEMENT ON BEHALF OF THE CITY; AUTHORIZING THE <br />PURCHASING MANAGER TO EXECUTE PURCHASING DOCUMENTS <br />WITH THE STATE ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />I <br /> <br />1. The City Council of the City of San Marcos wishes to purchase four Konica <br />Minolta copier/scanners (the "Equipment") as described in the attached Equipment Lease <br />Purchase Agreement and related documents (the "Agreement"). <br /> <br />2. The City has taken the necessary steps, including those related to the applicable <br />legal procurement requirements, to arrange for the acquisition of the Equipment. <br /> <br />3. The City finds that the execution of the Agreement in a principal amount not to <br />exceed $95,145.95 and interest in an amount not to exceed $9,074.05 for a total not to exceed <br />expense of $104,220.00 for the purpose of acquiring the Equipment is appropriate and necessary <br />for the function and operation of City business. <br /> <br />4. The City wishes to purchase the Equipment from Dahill Industries through the <br />Texas Local Government Purchasing Cooperative Buyboard . <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. It is hereby found and determined that the terms and conditions of the <br />Agreement in the form attached to this resolution are in the best interests of the City for the <br />acquisition of this Equipment. <br /> <br />I <br /> <br />PART 2. The City's obligations under the Agreement are subject to the annual <br />appropriation by the City Council, and will not constitute a general obligation of the City or an <br />
