<br />ORDINANCE NO. 2007- 62 <br /> <br />A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, EXTENDING THE EXCEPTION <br />FROM APPLICATION OF REVISED IMPACT FEES FOR <br />THE RIO MARC DEVELOPMENT'S EL CAMINO REAL <br />SUBDIVISION. <br /> <br />RECITIALS: <br /> <br />1. On September 25, 2002, the City of San Marcos enacted an ordinance that, <br />in part, provided for a revision of the amount of impact fees that would be paid by <br />developers and builders for connection to the City's water and waste water facilities. <br /> <br />2. On December 9, 2002, the City Council enacted Ordinance No. 2002-81 that <br />provided for an exception from the application of the revised impact fee amounts for <br />certain existing projects. The exception status effectively froze the old impact fees for <br />these certain projects; however, that exception expires, for all projects, on December <br />31, 2007. <br /> <br />3. Rio Marc Development, Ltd is seeking an extension of the exception from <br />payment of the revised impact fees until October 9, 2011. The revised exception is to <br />apply only on the 154 remaining lots in EI Camino Real Subdivision. <br /> <br />4. Granting this extension is in the public interest since the houses in this <br />subdivision fall into the affordable housing category. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The expiration of the exception to the revised amounts of the water <br />facilities impact fee and wastewater facilities impact fee as set forth in Ordinance <br />Number 2002-81 is extended from December 31, 2007, until October 9, 2011 for the <br />154 remaining lots in the EI Camino Real Subdivision. <br /> <br />SECTION 2. This ordinance is cumulative of all other ordinances of the City, <br />and this ordinance shall not operate to repeal or affect any of such other ordinances <br />except as to provisions that are in conflict with the provisions of this ordinance, in which <br />event the conflicting provisions are hereby superseded. <br /> <br />SECTION 3. This ordinance shall be in effect ten (10) days from and after <br />its passage, and the City Clerk will publish notice of its adoption in a newspaper <br />of general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading: September 18,2007 <br />
