<br />I <br /> <br />RESOLUTION 2007- 192 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, INDICATING ITS INTENTION TO ACCEPT THE ASSIGNMENT OF THE <br />RIGHTS AND OBLIGATIONS OF HAYS COUNTY UNDER THAT PORTION OF <br />A P ASS- THROUGH TOLL AGREEMENT BETWEEN HAYS COUNTY AND THE <br />TEXAS DEPARTMENT OF TRANSPORTATION THAT PERTAIN TO FM 110 <br />(SAN MARCOS LOOP) AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Hays County Commissioner's Court has taken official action indicating its intent to <br />assign to the City of San Marcos, Texas all of its rights and obligations under the portion of a Pass- <br />Through Toll Agreement with the Texas Department of Transportation (TxDOT) pertaining to FM 110 <br />(San Marcos Loop), subject to approval of the assignment by TxDOT. <br /> <br />2. The City Council desires to take official action indicating its intent to accept said <br />assignment. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />PART 1. The City of San Marcos expresses its intention to accept an assignment of Hays <br />County's rights and obligations under that portion of a Pass-Through Toll Agreement with TxDOT <br />pertaining to FM 110, subject to approval by TxDOT. The final form and content of an assignment <br />agreement will be subject to approval by the San Marcos City Council <br /> <br />PART 2. That this Resolution shall be in full force and effect from and after its passage <br />and will remain in effect unless subsequently repealed or otherwise amended. <br /> <br />ADOPTED this the~day of November ,2007. <br /> <br /> <br />Attest: ~. <br /> <br />.
