22 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, MARCH 28, 1988 PRESENT: Mayor J. E. Younger Mayor Pro-Tern Council Members Gerald G. Farr Karl W. Mayor Younger called the meeting to order at 7:30 p.m. Mayor Younger introduced for consideration approval of the minutes of the Regular Meeting held March 7, 1988. Ms. Kissler moved for approval of the minutes and Mr. Guerra seconded the motion, which passed unani- mously. Mayor Younger introduced for consideration approval of the minutes of the Emergency Meeting held March 16,1988. Mr. Hernandez moved for approval of the minutes and Mr. Guerra seconded the motion. On roll call the following vote was recorded: AYE: Guerra, Younger, Hernandez, Kissler. NAY: None. ABSTAIN: Brown, Farr. Mayor Younger introduced for consideration approval of an appointment to the Cemetery Commission (to complete the vacancy of Mr. Ortegon - 1989). Mayor Younger moved to appoint W. C. Carson and Mr. Guerra seconded the motion, which passed unanimously. Mayor Younger introduced Item l4.A. on -the agenda I a discussion of the status of the proposed Sexually Oriented Businesses Ordinance and direction to Staff. Mr. Hankins advised that the plaintiffs' motion for rehearing in the City of Dallas' Sexually Oriented Businesses Ordinance case has been denied by the Fifth Circuit, and that an appeal is being prepared to file with the U. S. Supreme Court. Mr. Hankins recommended the Council move on towards adoption of our Ordinance and that Staff needs direction of suggested amendments and for publication notice of a public hearing. It was consensus of Council to schedule the public hearing for the April 25, 1988 meeting. Mr. Guerra stated he would like for the Council to accept the Ordinance in its present written form and then hear what the citizens want. It was consensus of Council to make the draft Ordinance available to the public and for the Ordinance to be stamped "draft". Mr. Hankins stated he did not think there was a need for the S.U.P. (specific use permit) process when the Ordinance is so detailed but for some alternative way to be provided in the Ordinance to involve the Zoning Commission in the process. * Mr. Nicola present at 8:20 p.m.
