<br />40 <br /> <br />Regular Meeting <br /> <br />April 11, 1988 <br /> <br />Page 4 <br /> <br />Mayor Younger introduced for consideration direction to Staff to pur- <br />sue the LCRA Intervention Suit with John Davidson and Fred Saffer. <br />It was consensus of Council to direct Staff to pursue an Intervention <br />and to try to get other wholesale customers to join in the Interven- <br />tion with the City. <br /> <br />Mayor Younger introduced for consideration authorization to bid the <br />Highway 80 Water System Improvements. Mr. Guerra moved to authorize <br />bidding and Ms. Kissler seconded the motion. <br /> <br />Mayor Younger introduced a discussion regarding an Interlocal Agree- <br />ment with New Braunfels regarding a surface water development program. <br />Mr. Gonzalez prepared a Position Paper (attached) for the City to have <br />a beginning point to discuss with New Braunfels treatment of surface water <br />in the future. The GBRA study identified alternatives for San Marcos, <br />one of which was for New Braunfels to treat water for San Marcos. Mr. <br />Gonzalez advised the Council New Braunfels already has passed bonds <br />for a water treatment plant and will pursue doing so with or without <br />San Marcos. Mr. Gonzalez reviewed the "Position Paper" with the Council <br />and identified certain costs that would be involved. Mr. Gonzalez ad- <br />vised the Council the Staff would bring an item to the April 25 Council <br />Meeting re~arding this matter for the Council's direction. <br /> <br />Mr. Brown moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §§2(e) and (f), V.A.C.S., to discuss contemplated <br />litigation; matters where the duties of the City Attorney to the City <br />pursuant to the Code of Professional Responsibility of the State Bar of <br />Texas clearly conflicts with Article 6252-17; purchase of real pro- <br />perty; exchange of real property; and value of real property, <br />respectively, and Mr. Guerra seconded the motion, which passed unanl- <br />mously (8:40 p.m.). <br /> <br />Mr. Hernandez moved the Council reconvene at 9:40 p.m. and Ms. Kissler <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 9:4 <br />seconded by Mayor Younger.
