RESOLUTION N0.2007- 204 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ACCEPTING AND APPROVING A <br />MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY <br />AND THE TEXAS DEPARTMENT OF TRANSPORTATION <br />CONCERNING THE ADOPTION OF A FEDERALLY APPROVED <br />DISADVANTAGED BUSINESS ENTERPRISE PROGRAM; AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Federal government requires that all entities, who are recipients orsub-recipients of <br />federal highway funds, adopt a federally approved Disadvantaged Business Enterprise Program <br />("DBE Program"). The purpose of a DBE Program is to set forth goals and procedures for utilizing <br />qualified disadvantaged or minority businesses in the procurement of goods and services related to a <br />roadway construction project. <br />2. The Texas Department of Transportation ("TXDOT") has requested that the City enter <br />into a memorandum of understanding ("MOU") concerning the adoption of a Federally approved <br />DBE Program ("DBE") for all roadway construction projects in which the City receives federal <br />assistance through TxDOT. <br />3. One of the proj ects that requires the adoption of a DBE Program is the construction of the <br />Wonder World Drive Extension. The attached MOU will fulfill the City's requirement for adopting <br />a federally approved DBE Program required to proceed with the Wonder World Drive project. It is <br />also anticipated that the City will engage in other projects where the requirement for a DBE Program <br />exists. <br />4. In order to qualify as a DBE contractor on TxDOT projects, the firm must first pre-qualify <br />with TxDOT. The exact minimum percentage of DBE contractors or suppliers to be utilized during <br />construction will, in part, depend upon the number and type of qualified DBE businesses in the area <br />at the time the contract is let. <br />5. The City wishes to approve and accept the attached Memorandum of Understanding in <br />order to facilitate the construction of roadway projects, including the Wonder World Drive <br />Extension, that utilize federal funds. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The terms and conditions of the attached Memorandum of Understanding are <br />approved and accepted. <br />
