George Boeker provided <br />a report to the Council of some streets to be considered for overlay <br />with estimated costs. The Council directed two of the streets at <br />the bottom of the list (Edward Gary from MLK to Donaldson, new con- <br />struction - $15,000; Dailey from Mitchell to Johnson, add new base <br />material and overlay - $12,149) be included in the street overlay <br />program, that this year LBJ from Cardinal to Holland be deleted, <br />and that Haynes from Riverside to Houston be placed at the bottom <br />of the list of streets to be considered in the funding this year <br />(after Faris from Mitchell to dead end) in the event additional funds <br />over the $200,000 become available. <br /> <br />Mayor Younger introduced a Mayor's discussion item regarding the HEB <br />Building and direction for the Mayor to contact HEB to donate the <br />building to the City. It was consensus of Council for Mayor Younger <br />to pursue this. <br /> <br />Mayor Younger introduced a Mayor's discussion item regarding action <br />by the San Marcos Consolidated Independent School District regarding <br />Hwy. 123 and FM 62l intersection alternatives. A copy of Mayor Younger's <br />memorandum to the Council is attached to these minutes. <br /> <br />Mr. Brown moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §§2(e), (f) and (g), V.A.C.S., to discuss contem- <br />plated litigation and matters where the duties of the City Attorney <br />to the City pursuant to the Code of Professional Responsibility of the <br />State Bar of Texas clearly conflicts with Article 6252-17; purchase and <br />value of real property; and evaluation of a Dublic officer or employee, <br />respectively, and addendum, to dis.cuss the duties of a public officer or <br />employee (§2'[g]), ànd Mayor Younger seconded the motion, which passed <br />unanimously. <br />Mr. Hernandez moved the Council reconvene at 12:07 a.m. and Ms. Kissler <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval to authorize the <br />City Attorney to file civil actions under Chapter 54, Subchapter B of <br />the Local Government Code, against Clarence Miller and Bob Anderson <br />for violations of the City's zoning regulations pertaining to more than <br />two unrelated individuals living in a single-family residence in a <br />single-family dwelling district. Ms. Kissler moved to authorize and <br />Mr. Farr seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration an addendum, confirmation <br />of the City Manager's appointments to the Personnel Appeals Board. <br />Mr. Brown moved to table the appointments to the next meeting of the <br />City Council and Mr. Farr seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 12:12 a.m. on motion made by Mr. Hernandez <br />and seconded by Mr. Brown. <br /> <br />!JtJ L~ <br /> <br />Karl W.
