Utility district annexations (if applicable). <br />ARTICLE III <br />DEVELOPMENT PLAN, PARKS AND ROADWAYS <br />Section 3.01 Land Use. <br />Owner agrees to enter into a Development Agreement with the City to delay annexation of the <br />District by the City, establish certain restrictions and commitments imposed and made in connection with <br />the development of the District in order to provide increased certainty to Owner and City for a period of <br />years' and to identify land uses and other aspects of the development of the District under the authority <br />granted by Section 212.172 of the Texas Local Government Code. The Development Agreement must be <br />executed by Owner, approved by the City and fled in the Caldwell County Deed Records prior to any <br />Sub - District bond election. The Land will be developed in accordance with the standards and <br />requirements set forth in the Development Agreement. The Conceptual Land Use Plan attached hereto <br />as Exhibit "F" is for illustrative purposes only. The Development Agreement and land plan attached to <br />such Development Agreement will provide the land use regulations for the District. <br />Section 3.02 Parks and Open Space. <br />The parks and open space will be constructed and dedicated in accordance with the Development <br />Agreement. <br />Section 3.03 Roadway Improvements, right -of -way, easements and other land dedications. <br />The roadway improvements, right -of -way, easements and other land dedications will be <br />constructed and dedicated in accordance with the Development Agreement. <br />ARTICLE IV <br />WATER AND WASTEWATER SERVICES <br />Section 4.01 Water Services. <br />The water service to the District will be provided by a third party provider that holds the CCN to <br />serve the area and in accordance with an agreement between the third party provider, the Owner and the <br />District or Sub - District. <br />Section 4.02 Wastewater Services. <br />a. The wastewater service to the District will be provided by the City in accordance with a <br />wastewater service agreement, the form of which will be attached as an exhibit to the <br />Development Agreement. <br />b. The City hereby agrees to allow the extension, improvement of, and connection to City <br />wastewater facilities to provide service to the District up to a maximum of 7,530 service <br />units equivalent. Owner anticipates that the District will require 7,530 service units of <br />
