137 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL AND SMElT BOARD OF THE CITY OF SAN MARCOS, TEXAS, JUNE 27, 1988 PRESENT: Mayor and SMEU Board Member Kathy M. Hankins Larry Gilley Also Present: John Davidson, Patty Wenk, Mark Hendricks, Melissa Millecam, Judy Mitchell, Chris Tinnell, and others. Mayor Morris called the meeting to order at 7:00 p.m. Mr. Moore moved the Council and SMEU Board adjourn into Executive Session pursuant to Article 6252-17, §2(e), V.A.C.S., to discuss pending litigation (LCRA rate case before the PUC) and matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17, and Mr. Hernandez seconded the motion, which passed unanimously (7:03 p.m.). Mr. Hernandez moved the Council and SMEU Board reconvene at 7:44 p.m. and Mr. Plummer seconded the motion, which passed unanimously. Mayor Morris introduced for consideration recommendation for settle- ment proposal regarding stipulation and agreement in PUC Docket No. 8032 application of LCRA or authority to change rates (by Resolutions). The caption of the SMEU Board Resolution was read into the record as follows: A RESOLUTION OF THE ELECTRIC UTILITY BOARD APPROVING THE STIPULATION AND AGREEMENT BETWEEN LOWER COLORADO RIVER AUTHORITY AND THE CITY OF SAN MARCOS AND ITS AGENT, ELECTRIC UTILITY BOARD, IN DOCKET NO. 8032 BEFORE THE PUBLIC UTILITY COMMISSION OF TEXAS, APPLI- CATION OF LOWER COLORADO RIVER AUTHORITY TO CHANGE RATES. Mr. Phillips moved for adoption of the Resolution and Ms. Borm second- ed the motion, which passed unanimously.
