ORDINANCE NO. 2007- 69 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.762 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 225 RAMSAY STREET FROM "SF-6" SINGLE FAMILY RESIDENTIAL DISTRICT TO "MF-18" MULTI-FAMILY RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On October 9, 2007, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "SF-6" Single Family Residential District to "MF-18" Multi-Family District for a 0.762 acre tract of land located at 2101 Highway 123. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on October 9, 2007, consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the December 4, 2007, regarding the request. 4. All requirements of Chapter 1, Development Procedures, of the City Land Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to rezone the tract of property described in Section 1 above from "SF-6" Single Family Residential District to "MF-18" Multi-Family Residential District Street address: 225 Ramsay Size: 0.762 acre, more or less Legal description: T.l Chambers Survey, Abstract 2, as more particularly described on the field notes attached hereto as Exhibit A.
