23 Regular Meeting August 22, 1988 Page 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A CONTRACT BETWEEN SAID CITY AND THE TEXAS DEPART- MENT OF COMMERCE FOR THE PERFORMANCE BY CITY OF A COM- MUNITY DEVELOPMENT PROGRAM, AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID CONTRACT ON BEHALF OF SAID CITY, AUTHORIZING CITY STAFF TO SOLICIT PROPOSALS FROM INTERESTED PROJECT MANAGERS AND ENGINEERS FOR SERVICES IN CONNECTION WITH SAID PROGRAM AND DECLARING AN EFFECT- IVE DATE. Mayor Morris introduced for consideration award of bid on a water truck for the Public Works Department. Mr. Guerra moved to award bid to Hendrix GMC, Inc. in the amount of $28,820.00 and Ms. Kissler se- conded the motion, which passed unanimously. Mayor Morris introduced for consideration award of bid for the Fair- lawn Addition Improvements Phase I project. Mr. Hernandez moved to award bid to Austin Engineering Company in the amount of $137,327.50 and Mr. Guerra seconded the motion, which passed unamimously. Mr. Brown moved the Council adjourn into Executive Session pursuant to Article 6252-17, §§2(e) and (g), V.A.C.S., to discuss matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-l7¡ and appointment, employment, evaluation, reassign- ment and duties of a public employee, respectively, and Ms. Kissler seconded the motion, which passed únanimously (8:29 p.m.). Mr. Hernandez moved to reconvene at 10:29 p.m. and Ms. Kissler second- ed the motion, which passed unanimously. Mayor Morris introduced for consideration acceptance of the resignation of A. C. Gonzalez, City Manager, effective September 5,1988. Mr. Brown moved to accept Mr. Gonzalez' resignation and Ms. Kissler seconded the motion, which passed unanimously. Mayor Morris introduced for consideration action by the Council regarding the City Manager's position. Mr. Plummer moved to appoint Larry Gilley as City Manager and Mayor Morris seconded the motion. Mayor Morris stated Mr. Gilley's salary was set at $51,000 annually, $200.00 monthly car allowance, 30-day severance pay, 30-day termination notice, 3-month aSSëSSr::lent, 6-month review and salary review in 6 months the with effect- ive date of September 6, 1988. On roll call the following vote was re- corded: AYE: Brown, Morris, Kissler, Plummer. NAY: Hernandez, Guerra. ABSTAIN: None. Attached for the record is a letter from Billy G. Moore to the Mayor and Council dated August 19, 1988 in support of Mr. Gilley's appoint- ment. The meeting adjourned at 10:30 p.m. on motion made by Mr. Guerra and seconded by Ms. Kissler. m;i~
