<br />23 <br /> <br />Regular Meeting <br /> <br />August 22, 1988 <br /> <br />Page 6 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br />OF A CONTRACT BETWEEN SAID CITY AND THE TEXAS DEPART- <br />MENT OF COMMERCE FOR THE PERFORMANCE BY CITY OF A COM- <br />MUNITY DEVELOPMENT PROGRAM, AUTHORIZING THE MAYOR OF <br />SAID CITY TO EXECUTE SAID CONTRACT ON BEHALF OF SAID <br />CITY, AUTHORIZING CITY STAFF TO SOLICIT PROPOSALS FROM <br />INTERESTED PROJECT MANAGERS AND ENGINEERS FOR SERVICES <br />IN CONNECTION WITH SAID PROGRAM AND DECLARING AN EFFECT- <br />IVE DATE. <br /> <br />Mayor Morris introduced for consideration award of bid on a water <br />truck for the Public Works Department. Mr. Guerra moved to award bid <br />to Hendrix GMC, Inc. in the amount of $28,820.00 and Ms. Kissler se- <br />conded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration award of bid for the Fair- <br />lawn Addition Improvements Phase I project. Mr. Hernandez moved to <br />award bid to Austin Engineering Company in the amount of $137,327.50 <br />and Mr. Guerra seconded the motion, which passed unamimously. <br /> <br />Mr. Brown moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, §§2(e) and (g), V.A.C.S., to discuss matters where <br />the duties of the City Attorney to the City pursuant to the Code of <br />Professional Responsibility of the State Bar of Texas clearly conflicts <br />with Article 6252-l7¡ and appointment, employment, evaluation, reassign- <br />ment and duties of a public employee, respectively, and Ms. Kissler <br />seconded the motion, which passed únanimously (8:29 p.m.). <br /> <br />Mr. Hernandez moved to reconvene at 10:29 p.m. and Ms. Kissler second- <br />ed the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration acceptance of the resignation <br />of A. C. Gonzalez, City Manager, effective September 5,1988. Mr. Brown <br />moved to accept Mr. Gonzalez' resignation and Ms. Kissler seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration action by the Council regarding <br />the City Manager's position. Mr. Plummer moved to appoint Larry Gilley <br />as City Manager and Mayor Morris seconded the motion. Mayor Morris <br />stated Mr. Gilley's salary was set at $51,000 annually, $200.00 monthly <br />car allowance, 30-day severance pay, 30-day termination notice, 3-month <br />aSSëSSr::lent, 6-month review and salary review in 6 months the with effect- <br />ive date of September 6, 1988. On roll call the following vote was re- <br />corded: <br /> <br />AYE: <br /> <br />Brown, Morris, Kissler, Plummer. <br /> <br />NAY: <br /> <br />Hernandez, Guerra. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Attached for the record is a letter from Billy G.
