<br />66 <br /> <br />Regular Meeting <br /> <br />November 28, 1988 <br /> <br />Page 2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING APPENDIX A - GENERAL ZONING ORDINANCE OF THE <br />CODE OF ORDINANCES OF SAID CITY BY MODIFYING THE DEFINITION <br />OF HOME OCCUPATION; DELETING THE DEFINITION OF PLANNED UNIT <br />DEVELOPMENT; RENUMBERING THE REMAINING DEFINITIONS; <br />CLARIFYING THE APPLICATION PROCESS FOR MASTER PLAN <br />AMENDMENTS; ADDING "c" COMMERCIAL DISTRICT USE AS A <br />SPECIFIC USE TO LIGHT INDUSTRIAL DISTRICTS; ADDING "LI" <br />LIGHT INDUSTRIAL DISTRICT USES TO INDUSTRIAL DISTRICTS; <br />ADDING THE CONDITION THAT A SPECIFIC USE MUST BE CONSISTENT <br />WITH THE POLICIES OF THE MASTER PLAN; CLARIFYING THE <br />CONDITIONS ON A SPECIFIC USE PERMIT; ADDING CONDITIONS TO <br />OFF-STREET PARKING REQUIREMENTS IN THE CENTRAL BUSINESS <br />AREA, AND FOR DORMITORIES, FRATERNITY AND SORORITY <br />BUILDINGS; DELETING EXCESS LANGUAGE DESCRIBING THE CENTRAL <br />BUSINESS DISTRICT FOR OFF-STREET PARKING REQUIREMENTS; <br />DELETING A CROSS-REFERENCE IN NONCONFORMING LOTS; ADDING AN <br />ADDITIONAL CONDITION FOR A ZONING VARIANCE REQUEST TO THE <br />ZONING BOARD OF ADJUSTMENTS; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak for or against the amendment. No one did, so Mayor <br />Morris closed the public hearing. Mr. Guerra moved for approval <br />of the Ordinance on first reading and Mr. Moore seconded the <br />motion. Mr. Moore moved to amend the Ordinance in the caption to <br />read: ". . . CLARIFYING THE APPLICATION PROCESS FOR MASTER PLAN <br />LAND USE AMENDMENTS; 11 and in PART 3. to add: "... to clarify <br />the application process for Master Plan Land Use Amendments. . . <br />.," and Ms. Kissler seconded the motion, which passed <br />unanimously. Mr. Guerra moved to amend PART 10. Section 37.A.6. <br />from "Dormitories" to "Residence Halls" and Mr. Hernandez <br />seconded the motion, which passed unanimously. The definition <br />will need to be amended at a future reading to include this <br />amendment. The Council requested a definition be provided at the <br />next reading regarding what "structurally altered" includes (PART <br />9. Section 37). The Council then voted unanimously for approval <br />of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY ZONING 40.24 <br />ACRES, MORE OR LESS, OF LAND AREA IN THE J. M. VERAMENDI <br />SURVEY NO. ONE, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, <br />BEING A PORTION OF THAT 121.43 ACRE TRACT CONVEYED FROM <br />THOMAS T. SMITH, TRUSTEE, TO HEINZ SCHWADERLAPP, ET AL D/B/A <br />FINANCIAL MANAGEMENT GROUP BY DEED DATED APRIL 8, 1983 AS <br />RECORDED IN VOLUME 391, PAGE 692 OF THE HAYS COUNTY DEED <br />RECORDS, LOCATED ALONG THE NORTHWEST SIDE OF IH35, <br />APPROXIMATELY 540 FEET NORTH OF MCCARTY LANE, FROM "I" <br />(INDUSTRIAL DISTRICT) TO "c" (COMMERCIAL DISTRICT), SAID <br />REZONING BEING CONDITIONED ON SAID CITY'S RECEIVING OWNER'S <br />AUTHENTICATED, WRITTEN CONSENT TO THE REZONING AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished <br />to speak for or against the zoning amendment. No one did, so <br />Mayor Morris closed the public hearing.
