Regular Meeting December 11, 2007 Page 5 <br />provision to remove the wires and poles if the City has a special need or <br />event. Mr. Thomaides inquired to who is responsible for installing the <br />poles and wires. Mr. Kvanli stated the City is responsible for installing <br />the poles and his team is responsible for installing the wires. Mayor <br />Narvaiz stated this agreement is for one year, because this is a new area <br />for the City and one year will allow Staff to learn more. Mr. Jones <br />inquired to whether there would be a charge to the City for installing the <br />poles and cleaning up after the events. Mr. Cobb stated the Park Advisory <br />Board did not set a fee, they felt the minimum charges would be taken care <br />of with the tax dollars this group will bring to San Marcos. Mr. Bose <br />inquired to the size of these events. Mr. Cobb stated most of these events <br />have 20 slalom entries and 15 teams of kayaker polo, which is about 120 <br />people. The Council then voted unanimously for adoption of Resolution. <br />Mayor Narvaiz introduced a public hearing to receive comment for or against <br />the CDBG 2006 Consolidated Annual Performance and Evaluation Report <br />(CAPER). Mayor Narvaiz opened the public hearing and asked if anyone <br />wished to speak. No one did, so Mayor Narvaiz closed the public hearing. <br />Mayor Narvaiz introduced a public hearing to receive comment for or against <br />an Annexation of 4.306 acres of land that make up a portion of the <br />Yarrington Road right -of -way West of IH 35. Mayor Narvaiz opened the <br />public hearing and asked if anyone wished to speak. No one did, so Mayor <br />Narvaiz closed the public hearing. <br />Mayor Narvaiz introduced adoption of Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />AMENDING SECTION 78.102 OF THE SAN MARCOS CITY CODE TO INCREASE THE <br />HOTEL OCCUPANCY TAX FROM SEVEN PERCENT TO NINE PERCENT OF THE PRICE <br />PAID FOR A ROOM, EFFECTIVE JANUARY 1, 2008; PROVIDING THAT REVENUE <br />COLLECTED FROM THE TWO PERCENT INCREASE IN THE HOTEL OCCUPANCY TAX <br />RATE SHALL BE DEPOSITED INTO THE SAN MARCOS CONFERENCE CENTER VENUE <br />PROJECT FUND; AND DECLARING AN EMERGENCY. <br />Ms. Couch moved for adoption of Ordinance on emergency, and Mr. Guerrero <br />seconded the motion, which passed unanimously. <br />Mayor Narvaiz introduced for consideration the reconsideration of four <br />Zoning Ordinances adopted on December 4, 2007. The Council chose not to <br />reconsider the four Zoning Ordinances, the captions read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY TO ESTABLISH THE ZONING <br />FOR A 9.21 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED IN THE 1200 - <br />1300 BLOCKS OF SADLER DRIVE AS A "PDD" PLANNED DEVELOPMENT DISTRICT, <br />
