Annexation C &G Development Service Plan 3 commercial corners at Wonder World and Craddock intersection November 17, 2014 AN- 2014 -03 5. Operation and Maintenance of Water and Wastewater Facilities The annexation area is located within the City of San Marcos certified service area for water and is directly adjacent to the City of San Marcos certified service area for wastewater. The development agreement states the following: • Construction of a lift station and associated infrastructure to provide wastewater services to these tracts • C &G shall construct these improvements in accordance with plans and specifications acceptable to the City. • The city hereby agrees to participate in the cost of construction of a public lift station to be built by C &G. The applicant will be responsible for funding all associated equipment, facilities, and appurtenances to extend City water and wastewater services to the property which are not listed above as part of the development agreement. The City will provide water and wastewater service to properties in accordance with the City's development ordinances and utility extension and connection policies in place at the time of development. Upon completion and dedication of new facilities to the City, the City shall provide on -going maintenance and operation of those facilities. 6. Construction, Operation and Maintenance of Roads and Streets As new development occurs within the annexed area, the developers of property will be required to construct streets in accordance with the city's existing subdivision policies. 7. Electric Service The property is located in the San Marcos Electric Utility service area. The City of San Marcos Electric Utility will provide service in accordance with the City's development ordinances and utility extension and connection policies in place at the time of development. 8.Oneration and Maintenance of Parks. Plav2rounds, and/or Swimming Pools No parks, playgrounds and/or swimming pools currently exist within the proposed annexation area. The same standards and policies now established and in force within the city limits will be followed in maintaining and expanding recreational facilities to serve the annexed area. Upon annexation, the owners and residents of property located within the annexed area shall be entitled to the use of all municipal parks and recreational facilities, subject to the same restrictions, fees and availability that pertains to the use of those facilities by other citizens of the city. 9.Oneration and Maintenance of Other Public Facilities. Buildings and Services No other public facilities, buildings or services currently exist within the annexed area. The same standards and policies now established and in force within the city limits will be followed in maintaining and expanding other public facilities, building and services. Upon annexation, the owners and residents of property located within the annexed area shall be entitled to the use of all municipal facilities, buildings and services, subject to the same restrictions, fees and availability that pertains to the use of those facilities and services by other citizens of the city. 2 1 P a g v
