ORDINANCE NO. 2015 -06 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE RATES FOR BOTH <br />RESIDENTIAL AND MULTIFAMILY CUSTOMERS OF MUNICIPAL <br />SOLID WASTE PROGRAMS IN ACCORDANCE WITH SECTION <br />66.028(A) OF THE SAN MARCOS CODE OF ORDINANCES; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. On October 2, 2013 by Resolution 2013 -152R, the City Council approved a Fourth <br />Amended and Restated Contract (the "Contract ") for Collection and Disposal of Solid Waste and <br />Recyclable Materials with Texas Disposal Systems, Inc. (TDS). <br />2. The City avoided a rate increase in fiscal year 2014 and absorbed the contractually <br />required Consumer Price Index increase. <br />3. However, because the cost of disposing solid waste and costs to operate the Solid Waste <br />Program have increased over the last two years, it is necessary that the City adjust the rates in <br />fiscal year 2015 in order to meet current operating expenses as well as the Municipal Solid <br />Waste Comprehensive Plan goals. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. In accordance with Section 66.028(a) of the San Marcos Code of <br />Ordinances, the monthly rates for the collection and disposal of solid waste and recyclable <br />materials are amended in accordance with the attached Exhibit A. <br />SECTION 2. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 3. If any word, phrase, clause, sentence or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid provision. <br />SECTION 4. This Ordinance will take effect on March 1, 2015 and the City Clerk will <br />publish notice of its adoption in a newspaper of general circulation in the City immediately after <br />its adoption. <br />PASSED AND APPROVED on first reading on January 20, 2015 <br />PASSED on second reading, approved and adopted on February 3, 2015. <br />1 <br />
