Memo to Mayor and Council
Subject Lowman Ranch MUD
Dated January 30, 1987
Page 4

City.s Director of Planning be added to the
architectural control committee and given veto power
over its review of development site plans.

3.

Section 3.03 has been significantly restructured to
provide that the San Marcos Co~~olidated Independent
School District will be given an opportunity to purchase
15 acres at $10,000 per acre after 500 homes have been
constructed in the district. The school district will
then have two years to pass a successful bond election
to build a school on the property or the property will
revert to LRL.

4.

Section 3.04 has been redrafted to provided some
clarification. However, the phrase IIwhether contiguous
or notll should be deleted. Such considerations are
within the province of the Planning Commission and
cannot be determined by this agreement. With that
change, this provision will meet the minimum
requirements of the City regulations. The City Manager
would like to create an alternative provision for
operation and maintenance of the parkland by LRL or a
resident group until such time as the City annexes the
land. Such a provision would not conflict with the
subdivision ordinance and would provi4e some
consideration for the City to consent to the creation of
the proposed Lowman MUD. All that is being proposed in
this section is to comply with the City's ordinance
requirements as they now exist.

The staff hopes that the City Council will be able to give it
direction about the matters raised above at the Special City
Council Meeting to be held February 2, 1987.

~~

LAMAR W.
