RESOLUTION 2008-8R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS ACCEPTING THE DONATION OF A ONE ACRE, MORE OR LESS, TRACT OF LAND FROM COTTONWOOD CREEK JDR, LTD. TO BE USED FOR THE CONSTRUCTION OF THE COTTONWOOD CREEK ELEVATED WATER TANK; AUTHORIZING THE PURCHASE OF A 1.51 ACRE, MORE OR LESS, TRACT OF LAND FROM COTTONWOOD CREEK JDR, LTD. TO BE USED FOR THE PURPOSE OF ACCESS TO THE COTTONWOOD CREEK ELEVATED WATER TANK SITE AND FOR THE PROPOSED FUTURE LOCATION OF A FIRE/EMS STATION; AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH THE DONATION AND PURCHASE OF THESE TRACTS OF LAND; AND DECLARING AN EFFECTIVE DATE. RF.f iTAi.C• 1. In 2006 Cottonwood Creek JDR, Ltd. donated to the City a one acre tract of land to be used for the City's construction of the Cottonwood Creek Elevated Storage Tank. 2. Cottonwood Creek JDR, Ltd. has offered the City, for purchase, an additional 1.51 acre tract of land which is adjacent to the donated parcel of land for use as access to the Cottonwood Creek Elevated Storage Tank site and for the proposed future location of a Fire/EMS station. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The donation of a one acre tract of land (Attachment A) from Cottonwood Creek JDR, Ltd. for the location of the Cottonwood Creek Elevated Storage Tank is accepted by the City. PART 2. The purchase of a 1.51 acre, more or less, tract of land (Attachment B) from Cottonwood Creek JDR, Ltd. for the total purchase price of $150,000.00 plus closing costs is approved. PART 3. The Interim City Manager, Collette Jamison, is authorized to execute all necessary documents in connection with the donation and purchase of the two tracts of land described above on behalf of the City. PART 4. This Resolution is in full force and effect from and after its passage. ADOPTED on the 15th day of January, 2008.
