appropriate Sponsoring Public Entities may also amend or repeal the provisions of this Article if <br />the SEC amends or repeals the applicable provision of the Rule or a court of final jurisdiction <br />enters judgment that such provisions of the Rule are invalid, but only if and to the extent that the <br />provisions of this sentence would not prevent an underwriter from lawfully purchasing or selling <br />Bonds in the primary offering of the Bonds. <br />ARTICLE VII <br />COMPLIANCE WITH FEDERAL, STATE AND LOCAL LAWS <br />Section 71 Compliance with Federal. State and Local Laws. In addition to the <br />provisions of Section 8.8 hereof, this Contract is subject to all applicable federal and State laws <br />and any applicable permits, ordinances, rules, orders and regulations of any local, state or federal <br />government authority having or asserting jurisdiction. The Contract is specifically subject to the <br />rules of the TCEQ, and the Agency shall have the right to terminate this Contract with respect to <br />a Sponsoring Public Entity upon the Sponsoring Public Entity's non-compliance with the rules <br />promulgated by the TCEQ. Pursuant to those rules the parties will comply with all of the <br />applicable requirements in Section 7.2 hereof. <br />Section 7 Recordkeeping and Reporting. The Sponsoring Public Entities and <br />the Agency shall maintain records relating to the Agency on site for a period of five (5) years. <br />(a) Records to be maintained by the Agency include: <br />(i) copies of notifications made to the TCEQ concerning water <br />projects; <br />(ii) as applicable, copies of contracts made with each water user, <br />(iii) records of volume of water delivered to each water user per <br />delivery; and <br />(iv) water quality analyses. <br />(b) Records to be maintained by each Sponsoring Public Entity include: <br />(i) records of volume of water delivered to the Sponsoring Public <br />Entity by the Agency; <br />(ii) records of water quality analysis of the Sponsoring Public Entity's <br />distribution system; <br />(iii) calibration records for any check meters (as described in Section <br />4.2(e) above) owned, maintained, or controlled by the Sponsoring Public Entity, <br />and <br />(iv) maintenance records pertinent to each Agency delivery point to the <br />Sponsoring Public Entity. <br />(c) The Agency shall report to the TCEQ on a monthly basis the felewving <br />information on forms furnished by the Executive Director of the TCEQ: <br />(i) volume of water delivered to each Sponsoring Public Entity. <br />-29-
