RESOLUTION NO. 2015-28R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />SUPPORTING THE ADOPTION OF LEGISLATION TO AMEND SECTION 26.05(b) OF <br />THE TEXAS TAX CODE REGARDING THE FORM OF A MOTION TO SET A <br />PROPERTY TAX RATE THAT EXCEEDS THE EFFECTIVE TAX RATE SO THAT <br />GOVERNING BODIES WILL NO LONGER BE REQUIRED TO FALSELY STATE <br />THAT THEY ARE VOTING TO INCREASE IN THE TAX RATE WHEN THE <br />PROPOSED RATE IS THE SAME OR LOWER THAN THE RATE IN THE PRIOR TAX <br />YEAR; SUPPORTING H.B. 1086 FILED BY REPRESENTATIVE JASON ISAAC AND <br />S.B. 744 FILED BY SENATOR JUDITH ZAFFIRINI FOR THAT PURPOSE; AND <br />PROVIDING AN EFFECTIVE DATE <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The City of San Marcos supports the adoption of legislation to amend <br />Section 26.05(B) of the Texas Tax Code to revise the form of a motion to set a property tax rate <br />that exceeds the effective rate so that governing bodies will no longer be required by law to falsely <br />state that they are voting to increase the tax rate when the proposed tax rate is the same or lower <br />than the rate set in the prior tax year. <br />PART 2. The City Council supports H.B. 1086 filed by Representative Jason Isaac <br />and S.B. 744 filed by Senator Judith Zaffirini to achieve the purposes set forth in Part 1 of this <br />resolution <br />PART 3.
