INTERLOCAL AGREEMENT BETWEEN <br />THE GUADALUPE BLANCO RIVER AUTHORITY <br />AND <br />THE CITY OF SAN MARCOS <br />THIS AGREEMENT is made and entered into pursuant to the Interlocal <br />Cooperation Act, TEX GOVT CODE ANN., ch. 791, by and among the <br />Guadalupe Blanco River Authority (GBRA), a body corporate and politic under <br />the laws of the State of Texas, and the City of San Marcos ( "Local Participant "), a <br />body corporate and politic under the laws of the State of Texas. <br />WITNESSETH: <br />WHEREAS, periodic flooding of the Blanco River poses a significant risk <br />to life and property in the vicinity of Hays County and the City of San Marcos; and <br />WHEREAS, GBRA wishes to develop information to improve <br />understanding of regional flooding issues within the Guadalupe River basin and it <br />is beneficial for Local Participant to participate in the Project; and <br />WHEREAS, the National Weather Service has indicated that it will be able <br />to enhance the capabilities of its' riverine flood forecasting model to provide a <br />forecast point in the vicinity of the City of San Marcos should a United States <br />Geological Survey (USGS) streamflow gauging station be installed and <br />maintained in that location; and <br />WHEREAS, GBRA, Hays County, and the City of San Marcos desire to <br />participate in the Project and are willing to jointly fund installation and <br />maintenance of the USGS streamflow gauging station necessary to update the <br />National Weather Service flood forecasting model; and <br />NOW, THERFORE, for and in consideration of the mutual covenants, <br />agreements, and benefits to the parties herein named, the parties agree as <br />follows: <br />Section 1. FISCAL PROVISIONS. An initial payment of $25,000 must be paid <br />to USGS to cover the construction costs associated with installation of the <br />gauging station. In subsequent years the USGS will require an annual payment <br />to cover operation and maintenance expenses. The USGS currently requires a <br />payment of $15,450 for operation and maintenance; however, it should be <br />understood that the USGS may increase this amount over time. The installation <br />cost and operation and maintenance expenses shall be shared equally between <br />GBRA, Hays County, and the City of San Marcos subject to the terms of this <br />agreement. Local Participant will be responsible for paying its' cost share to <br />GBRA. GBRA will be responsible for making payments to USGS for this gauging <br />station as long as this agreement remains in effect. <br />
