Mayor Younger <br />moved for approval and Ms. Kissler seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Younger introduced for consideratio~ approval to alloc3.te funds <br />from contingency funds for payment to State and Local Legal Center in <br />the amount of $250.00 for continuance of advocacy of municipal inter- <br />ests before the United Stat.es Supreme Court (sponsored by National <br />League of Cities). Ms. Kissler moved for approval and Mr. Guerra se- <br />conded the motion. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Farr, Guerra, Kissler, Nicola. <br /> <br />NAY: <br /> <br />Coddington, Younger. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Younger introduced a discussion by San Marcos Ranch Apartments <br />(R. C. Hoppe & Co., Inc.) regardin<J the City's L.U.E. computa.tions. <br />Wiley Mitchell of Hoppe & Co. provided infcrmation in the Council;s <br />packets regarding L.U.E. usage in Universal City. Mr. Boeker advised <br />the Council the average apartment usage in San Marcos is 7,000 per <br />month per unit as compared to the average single-family usage of 10,000 <br />per month per unit. Mr. Farr stated maybe cr..nservatism should be looked <br />at if any apartment complexes are conserving and have a program to <br />encourage/reward for conservation. Mr. Boeker stated the comparison <br />wi th Uni \7ersal City may be affected by the numb,?r of people per unit. <br />Mr. Gonzalez stated the implementation would be difficult if the City <br />looks at the average of individual apartment complexes. Mr. Farr stated <br />we should be charging for actual use and should look at refining our <br />procedure. Mr. Gonzalez remind'S:d th9 Council the City needs to receive <br />funds to provide facilities for growth coming on line. Mr. Brown stated <br />maybe we can adjust morE fairly and rewal-d for conservation. Mayor <br />Younger directed Staff see if we can reduce our charge. Mr. Farr stated <br />for Staff to look at our historical data and determine what factor of <br />LUE is appropriate for apartments. <br /> <br />Mr. Brown moved the Council adjourn into Executive Session pursuant to <br />ArticlE~ 6252-17, §§2 (e), (f) and (g), V.A.C.S., to discuss matters where <br />the duties of 'f:he City Attorney to the City pursuant to the Code of Pro- <br />fessional Responsibility of the State Bar of Texas clearly conflicts with <br />¡~.rticle 6252-17; purchase of real property; employment of a public officer <br />or employee (Associate Municipal Court Judge) and complaints or charges <br />against a public officer or employee, respectively and Mayor Younger se- <br />conded the motion, which passed unanimously (10:43 p.m.). <br /> <br />Mr. Nicola moved the Council reconvene at 11:13 p.m. and Mr. Brown se- <br />conded the motion, which passed unanimously. <br /> <br />Mr. Farr moved the Council reconsider Item l2.C., a Resolution fro~ <br />earlier in this meeting and Mr. Brown seconded the motion, whicb passed <br />unanimously. The Council then reconsidered adoption of Item 12.C., a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS APPROVING <br />THE TERMS AND CONDITIONS OF A PROPOSED AGREEMENT WITH <br />THE CITY OF KYLE, TEXAS ESTABLISHING RESPECTIVE EXTRA- <br />TERRITORIAL JURISDICTION BOUNDARIES, AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF SAID CITY, <br />AND DECLARING AN EFFECTIVE DATE. <br />
