<br />ORDINANCE 1987- 58
<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE SPECIAL RUNOFF
<br />ELECTION HELD ON APRIL 25, 1987 FOR THE
<br />PURPOSE OF ELECTING A CITY COUNCIL MEMBER,
<br />PLACE THREE, AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />by ordinance duly enacted on April 9, 1987, ordered that a
<br />special runoff election be held on April 25, 1987 for the purpose
<br />of electing a city council member, place three; and,
<br />
<br />WHEREAS, notice of said election was duly published in the
<br />San Marcos Daily Record on April 12, 1987; and,
<br />
<br />WHEREAS, copies of said notice were duly posted at each city
<br />election precinct polling place prior to said election, and a copy
<br />of same was posted on the bulletin board at City Hall on April 9,
<br />1987; and,
<br />
<br />WHEREAS, said election was duly and legally held on the 25th
<br />day of April, 1987, in conformity with the election laws of the
<br />State of Texas, and the results of said election have been
<br />certified and returned by the proper judges and clerks thereof;
<br />and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas,
<br />with the following members present: Karl Brown, Gerald G. Farr,
<br />J. E. YÖunqer, Fred Guerra, Betty Jane Kissler and William C. Nicola
<br />has today considered the returns of said special runoff election
<br />held on the 25th day of April, 1987; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the said election was in all respects lawfully held; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of said election is correct;
<br />now, therefore,
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the special runoff City election of April
<br />25, 1987 was duly called, that notice of said election was given
<br />in accordance with law, and that said election was held in
<br />accordance with law.
<br />
<br />SECTION 2. That the tabulation of votes cast in the
<br />special runoff election held on April 25, 1987 for the purpose of
<br />electing a city council member, place three, made and certified to
<br />by the City Secretary of the City of San Marcos, a copy of which
<br />is attached hereto and made a part hereof, be, and the same is
<br />hereby, adopted as the official tabulation of the votes cast at
<br />said election and that said tabulation be filed and recorded in
<br />the official records of the City of San Marcos as the official
<br />canvass of said election.

<br />SECTION 3. That the said official canvass of the returns
<br />of said election reflects the following:
