There was no one <br />present to speak for or in opposition of the Resolution. Mayor <br />Younger declared the public hearing closed. Ms. Kissler moved to <br />table this item until the May 11, 1987 Council Meeting, and Mr. <br />Brown seconded the motion which passed unanimously. <br /> <br />Mayor Younger introduced for consideration adoption of Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />AN AGREEMENT BETWEEN SAID CITY AND SOUTHWEST TEXAS <br />STATE UNIVERSITY, AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT, ABANDONING AND VACATING PORTIONS OF <br />LIVE OAK, ELM, MATTHEWS, GUADALUPE, GRACE, AND MOORE <br />STREETS AND AN ALLEY IN SAID CITY, AUTHORIZING THE <br />MAYOR OF SAID CITY TO EXECUTE A SPECIAL WARRANTY <br />DEED, AND DECLARING AN EMERGENCY. <br /> <br />Mr. Guerra moved for adoption of the Ordinance and Ms, Kissler seconded <br />the motion. City Manager Gonzalez handed out the appraisal to Council <br />Members. Mayor Younger moved to include the following language to Section <br />9 of the Ordinance "... City; and to declare Moore Street from the <br />intersection with Smith Avenue up the hill in a northwest direction a <br />one-way street in the northwest direction and that SWT will accept/ <br />provide signs on SWT property declaring a one-way status at top of <br />hill and at any other intersections with Moore Street on SWT property. II <br />and Mr. Guerra seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE Brown, <br />NAY None <br />ABSTAIN Nicola <br /> <br />Farr, Guerra, Younger, Hernandez, Kissler <br /> <br />Mr. Nicola asked if persons who had ties to the University be appro- <br />priate to vote on University related matters. He asked City Attorney <br />Hankins if the City had asked for or received an Attorney General <br />opinion on the matter. Mr. Hankins stated that the City would need to <br />contact our State Legislators to request an Attorney General <br />opinion. It was concensus of the Council for City Attorney Hankins to <br />contact Senator Barrientos and Representative Cooper to obtain an Attorney <br />General's opinion on this matter. Mayor Younger moved to amend the <br />License Agreement Section 11,1. to add the following sentence at the <br />end of the section: "Licensee agrees to repair any damages to Licensor's <br />property, II and Ms. Kissler seconded the motion which passed unanimously. <br />Mr. Brown moved to amend the Ordinance page 2, third Whereas to insert <br />$43,845.00 in the blank as the fair market value and Ms. Kissler se- <br />conded the motion which passed unanimously. The Council then voted <br />as follows on adoption of the Ordinance: <br /> <br />AYE <br /> <br />Brown, Farr, Guerra, Younger, Hernandez, Kissler <br /> <br />NAY <br /> <br />Nicola <br /> <br />ABSTAIN <br /> <br />None <br /> <br />Mayor Younger introduced for consideration approval to change the May <br />25, 1987 Regular meeting date to May 27, 1987. Ms. Kissler moved to <br />hold the second Regular meeting in May on May 27, 1987 and Mayor <br />Younger seconded the motion which passed unanimously. <br />
