(4) the District is entirely within the city's extraterritorial jurisdiction; <br />(5) the development supported by the District provides the following extraordinary public <br />benefits: <br />a. The City will receive a total of $164,231 out of the net Developer <br />reimbursement from the proceeds from the issuance of bonds in conjunction <br />with the District; <br />b. The City may impose a sales and use tax on all eligible property within the <br />District and receive sixty percent (60 %) of the revenue collected through a <br />Strategic Partnership Agreement as provided in Section 2.02(a) herein; <br />C. City's land use controls will apply within the District pursuant to a <br />Development Agreement; <br />d. In conjunction with the District, the City will receive parkland and public <br />improvements will be constructed in accordance with the City's Land <br />Development Code. <br />Therefore, for good and valuable consideration, the receipt and sufficiency of which are <br />hereby acknowledged, including the agreements set forth below, the parties contract as follows. <br />ARTICLE I <br />DEFINITIONS <br />Section 1.01. Definitions. In addition to the terms defined elsewhere in this Agreement <br />or in the City's ordinances, the following terms and phrases used in this Agreement will have <br />the meanings set out below: <br />Agreement: This Consent Agreement between the City of San Marcos, Texas and the <br />Developer. <br />Bonds. As used throughout this Agreement, "bonds" includes notes and other <br />obligations. <br />Cam: The City of San Marcos, Texas, a home rule city located in Hays County, Texas. <br />Commission: The Texas Commission on Environmental Quality or its successor state <br />agency. <br />Developer: LaSalle Holdings, Ltd., a Texas Limited Partnership, or its successors and <br />assigns under this Agreement. <br />Development Agreement: The Development Agreement concerning the LaSalle <br />Project, as amended from time to time by the parties. <br />District: The financing district known as LaSalle MUD No. 1 created by special act of <br />the 83rd Texas Legislature over the portion of the Land described by metes and bounds in <br />Exhibit A. <br />2 <br />
