<br />119 <br /> <br />Regular Meeting <br /> <br />November 9, 1987 <br /> <br />Page 4 <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, AÞIENDING CHAPTER 3 OF THE SAN MARCOS CODE OF <br />ORDINANCES BY ADDING A PROVISION EXEMPTING POLICE <br />DOGS FROM SECTION 3-49, IMPOUNDMENT OF DOGS WHICH <br />HAVE BITTEN PERSONS; AND BY ADDING A PROVISION PRO- <br />HIBITING PERSONS FROM AGITATING POLICE DOGS; AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Farr seconded the motion. Mayor Younger stated he thought there <br />should be an amendment in Section 1 that if the dog broke the skin, he <br />should be impounded. Chief Galchutt stated there will be detailed in- <br />formation in the Police Procedures covering the dog when it has been <br />finalized. Mayor Younger moved to table the Ordinance until the Council <br />received further clarification and Mr. Farr seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Younger introduced for reconsideration approval of an Ordinance on <br />first reading, the caption which was read as follows (denied by Council <br />September 28, 1987): <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX C, ARTICLE V, PLANNED <br />UNIT DEVELOPMENT, SECTION F(4) OF THE SAN MARCOS CODE <br />OR ORDINANCES BY ELIMINATING THE REQUIREMENT THAT THE <br />MINIMUM SITE AREA FOR A PLANNED UNIT DEVELOPMENT IS 5 <br />ACRES; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. Mr. Farr stated in SECTION 1, Section <br />F.4. that regardless of its size, a PUD could be anywhere when size is <br />not determined without necessity of a variance. Mr. Robbins stated there <br />is some limitation or it would be considered spot zoning. On roll call <br />the following vote was recorded: <br /> <br />AYE: <br /> <br />Guerra, Younger. <br /> <br />NAY: <br /> <br />Brown, Farr, Hernandez, Kissler. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />The motion failed. The Council directed the Ordinance come back to them <br />for consideration as one acre. <br /> <br />Mayor Younger introduced for consideration approval of four Ordinances <br />on second reading and adoption of five Ordinances on third and final <br />reading by consensus. Mayor Younger moved to consider Item 8.A. (4) <br />after Executive Session and Mr. Hernandez seconded the motion, which <br />passed unanimously. Mr. Brown moved for approval of the remaining <br />three Ordinances on second reading and adoption of five Ordinances <br />on third and final reading by consensus and Mayor Younger seconded the <br />motion, which passed unanimously (Mayor Younger voting NAY on 8.B. (1), <br />(2) and (3». The captions of these Ordinances read as follows: <br /> <br />Approval of Ordinances on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ORDINANCE 1985-46 TO CHANGE <br />ARTICLE III TO ARTICLE IV AND AMENDING SAID ARTICLE <br />TO PROVIDE FOR THE ASSESSMENT OF A $10.00 FEE FOR THE <br />PREPARATION BY THE TAX COLLECTOR OF TAX CERTIFICATES <br />AND DECLARING AN EFFECTIVE DATE. <br />
