applicable ordinances of the City, subject to the waivers set forth in Part 3 above. <br />Section 8.12. Binding on Successors; Recording. This Agreement is binding on all <br />successors and assigns of the Owner and shall run with the Site. The Owner hereby grants its <br />consent to the City to record this Agreement, a memorandum of this Agreement or other <br />instrument against the Site providing notice of the waivers granted and limitations on such <br />waivers under this Agreement in the Official Public Records of Hays County, Texas. <br />Section 8.13. Estoppel. Upon written request by the Owner, the City shall execute and <br />deliver to the Owner an estoppel certificate certifying as follows: (a) whether this Agreement is <br />unmodified and in full force and effect (or if modified, disclosure of such modifications and <br />whether this Agreement is in full force and effect as modified); (b) whether to the City's <br />knowledge, the Owner is in default under this Agreement; and (c) any other reasonable factual <br />inquiries a party may request regarding this Agreement. <br />[SIGNATURES ON NEXT PAGE[ <br />
