C. the City has received Sales Tax Revenues for the preceding year from the <br />Texas Comptroller of Public Accounts; and <br />d. funds are appropriated by the San Marcos City Council for the specific <br />purpose of making a Chapter 380 Payment under this Agreement as part of the City's <br />ordinary budget and appropriations approval process or through any subsequent <br />appropriation. <br />Provided the foregoing conditions have been satisfied and Amazon is, otherwise, in compliance <br />with this Agreement, the City shall pay to Amazon any Chapter 380 Payments due within 30 <br />days after the last to occur of the events in subsections (a) through (d). <br />Section 4.03. Payment Period for Ad Valorem Tax Portion of Chapter 380 <br />Payments. Chapter 380 Payments made by the City between and including the years 2018 <br />through 2027 shall include rebates associated with Personal Property Taxes and Real Property <br />Taxes attributable to the previous tax years. Except as provided below, no rebates associated <br />with Personal Property Taxes and Real Property taxes shall be included in any Chapter 380 <br />Payments made in 2028 through the end of the Term. <br />a. Extension of Payment Period for Ad Valorem Portion of Chapter 380 <br />Payments. If Amazon and its Affiliates (i) create and maintain at least 1,000 Jobs for a <br />continuous period of at least five years preceding and until December 31, 2027, and (ii) <br />have an annualized aggregate payroll of at least $32,240,000 for a continuous period of at <br />least five years preceding and until December 31, 2027, then Amazon shall be entitled to <br />up to five additional annual Chapter 380 Payments that include rebates associated with <br />Personal Property Taxes and Real Property Taxes.
