Mr. Taylor will advise the Council when he has researched this question. Mr. Moore stated he wants to hold the line on the tax rate but is willing to raise it if it is needed. -. -. Mr. Plummer introduced the City Attorney's Report. Mr. Taylor had no report. Mr. Plummer introduced the City Council's Report. The council had no report. The Council moved to Item 12 on the Agenda, the Question and Answer Session. Rick Hernandez made comments regarding the budget. He is opposed to the Police Reserves, opposed to the Assistant city Manager position and wants the City to work towards more minority recruitment on the staff. The Council returned to Item 11 on the Agenda. Mr. Plummer introduced for consideration approval for consideration of property tax increase at a public hearing to be conducted on Tuesday, September 7, 1993 at 7:30 p.m. in the Council Chambers at City Hall, 630 E. Hopkins Street. Mr. Moore moved to set the~consideration of a property tax rate increase public hearing for September 7, 1993, at 7:30 p.m. and Mr. Mooney seconded the motion, which passed unanimously. It was consensus of Council for the public notice to show the amount of tax rate to be 46 cents, an estimated 46.6% lncrease. Mr. Plummer introduced an Executive Session pursuant to Article 6252-17, sections 2(e) and (f), V.A.C.S., to discuss pending litigation (Burleson vs. city of San Marcos; Tarbutton vs. city of San Marcos) and matters where the City Attorney's ethical duty to the city clearly conflicts with Article 6252-17; and purchase of real property¡ respectively. Mr. .Guerra moved for adjournment into Executive Session at 9:38 p.m. and Mr. Hart seconded the motion, which passed unanimously. Mr. Guerra moved to reconvene from Executive Session at 11:11 p.m. and Mr. Hart seconded the motion, which passed unanimously. Mr. Plummer introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS¡ TEXAS, APPROVING AN APPLICATION TO THE TEXAS PARKS AND WILDLIFE DEPARTMENT FOR SAN MARCOS PARK AND WILDLIFE HABITAT PHASE II; DESIGNATING THE CITY MANAGER TO ACT ON BEHALF OF THE CITY REGARDING THE GRANT APPLICATION; CERTIFYING THAT THE CITY OF SAN MARCOS IS ELIGIBLE TO PARTICIPATE IN THE GRANT PROGRAM; AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for adoption of the Resolution and Mr. Moore seconded the motion, which passed unanimously.
