2 Regular Meeting October 25, 1993 Page 2 Mayor Morris opened the public hearing and asked if anyone wished to speak for or against the zoning amendment. No one did, so Mayor Morris closed the public hearing. Mr. Hart moved for adoption of the Zoning Ordinance and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of an Ordinance ~ on emergency, the caption which was read as follows: . AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1992-1993 FISCAL YEAR TO COVER OVERRUNS OF DEPARTMENTS WITHIN THE GENERAL FUND; AND DECLARING AN EMERGENCY. Mr. Mooney m9ved for adoption of the Ordinance on emergency and Mr. Moore secondèd the motion, which passed unanimously. Mayor Morris introduced for consideration reconsideration of a Zoning Ordinance. The Council did not wish to reconsider the Ordinance. The caption of the Ordinance reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A PORTION OF LOTS 11 AND 12, BLOCK 12, FIRST SECTION, VICTORY GARDENS ADDITION TO THE CITY OF SAN MARCOS, AS RECORDED IN VOLUME 128, PAGE 46 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 405 ARMSTRONG STREET, FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND DECLARING AN EFFECTIVE DATE. Mayor Morris introduced for consideration approval of the minutes of the Regular Meeting held October 11, 1993, approval of two Ordinances on second reading, adoption of an Ordinance on third and final reading, adoption of eight Resolutions, approval of Change Order #3 for the Public Library Construction project in the additional amount of $19,077.00, reconsideration of the Revolving Loan Fund Program award to J & W Donuts in the amount of $12,500.00, approval to set the city Council Regular Meeting dates for December, 1993 on Monday, December 6, 1993 at 7:30 p.m. and Monday, December 13, 1993 at 7:30 p.m. on consensus. The Council removed Items 10.A., 10.D. (8) and 10.F. to be considered separately. Mr. Hart moved for approval of the two Ordinances on second reading, for adoption of the Ordinance on third and final reading, for adoption of the remaining seven Resolutions, for approval of Change Order #3 for the Library Project, and for approval of the Regular Meeting dates in December as December 6 and December 13 on consensus and Mr. Moore seconded the motion, which passed unanimously. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE QUALIFICATIONS FOR APPOINTMENT TO THE CITY ELECTRICAL BOARD; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. Adoption of Ordinance on third and final reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING AND CLARIFYING CHAPTER 26, TAXATION, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EFFECTIVE DATE.
