KITUNP M 1. To increase landfill diversion, and after a one -year pilot program, the City wishes to make curbside green waste cart services available to the public. 2. Due to safety issues, Texas Disposal Systems is discontinuing servicing of the downtown public trash containers. 3. In order to align the contract with the fiscal year and to assist staff in preparing for the budget process, the annual increase computation will be figured based on an annual three percent (3 %) flat rate rather than the Consumer Price Index Rate. BE IT RESOLVED BY THE CITE' COUNCIL. OF THE CITY OF SAN MARC ®S, TEXAS: PART 1. The attached Fifth Amended and Restated Contract between the City and Texas Disposal Systems, Inc. for Collection and Disposal of Solid Waste and Recyclable Materials is approved. PART 2. The City Manager or his designee, is authorized to execute the contract on behalf of the City. PART 3. This Resolution shall be in full force and effect immediately from and after its passage.
