(11) removed <br />from the consensus agenda, adoption of a Resolution, the caption <br />which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER AGREEMENT <br />BETWEEN THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY TO EXTEND <br />THE TERM OF THE RIVER STEWARDSHIP PROGRAM AGREEMENT; ._, <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF <br />OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Plummer moved for adoption of the Resolution anti Mr. Mooney <br />seconded the motion. Mr. Gilley is going to ascertain what it would <br />cost to repair the cutter boat. The Council discussed the need for <br />the growth in the river to be clipped and removed from the river. <br />On roll call the following vote was recorded: <br /> <br />AYE: Mooney, Hart, Morris, Guerra, Cox, Plummer. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Moore. <br />, <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />provided the Council with August usage information regarding SMEU <br />rates. (2) The Council requested information regarding attendance <br />of Planning and Zoning commissioners. <br /> <br />Mayor Morris introduced the city Attorney's Report. Mr. Taylor had <br />no report at this meeting. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mayor <br />Morris has been approached by some citizens who want a River Task <br />Force to be appointed to do a master plan for the river to include <br />landscaping along the river, mostly in parkland. Mr. Moore <br />expressed an interest in this group working in conjunction with the <br />Park Master Plan under the direction of Rodney Cobb. (2) Mr. <br />Mooney expressed interest in more enforcement of the unrelated <br />persons in a household. He wants the process to speed up, and there <br />needs to be enforcement of tenants and owners. Ron Patterson <br />presently sends letters notifying owners complaints have been made <br />and the need to rectify. Mr. Gilley stated police investigation of <br />these matters is not good use of our officers. Mr. Gilley will <br />bring the Council recommendations and methods of improvement of the <br />process. (3) Mr. Mooney stated trash and items such as couches are <br />stacked up for long periods of time and was advised these matters <br />are enforced by the Health Department. (4) The Library Board has <br />requested Council to consider allowing two members of their Board <br />whose terms expire to remain on the Board for an additional six <br />months to see the completion of the new Library. (5) The Council <br />was reminded complaints should be directed to the City Manager or <br />city Attorney to handle. (6) Mr. Cox expressed concern regarding a <br />leaking water main. Mr. Gilley advised it would be more expensive <br />to repair than to allow the leak, but because of the city's water <br />conservation efforts, we would pursue correcting the leak. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, section 2(e), V.A.C.S., to discuss pending litigation (city <br />of San Marcos vs. Frost National Bank, Et AI) and mattecs where the <br />city Attorney's ethical duty to the city clearly conflicts with <br />
