<br /> 47 <br />Regular Meeting September 13, 1993 Page 5 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER AGREEMENT <br /> BETWEEN THE CITY AND G. A. POWERS COMPANY TO EXTEND THE TERM OF <br /> THE ANNUAL CONTRACT FOR THE PURCHASE OF WATER METERS FOR ONE <br /> YEAR; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br /> BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING FINAL PAYMENT TO DU-MOR ENTERPRISES, INC. FOR <br /> COMPLETION OF THE BLANCO RIVER WATER LINE CONSTRUCTION PROJECT; <br /> ACCEPTING THE PROJECT FOR USE BY THE CITY; AUTHORIZING FINAL <br /> PAYMENT IN THE AMOUNT OF $15,730.61; AND DECLARING AN EFFECTIVE <br /> DATE. <br />Mayor Morris introduced for consideration Item 12.C. (7) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AWARDING A CONTRACT FOR HAULING SERVICES TO THOMAS <br /> TRUCKING, INC.; AUTHORIZING THE PURCHASING MANAGER TO EXECUTE <br /> CONTRACT DOCUMENTS ON BEHALF OF THE CITY¡ AND DECLARING AN <br /> EFFECTIVE DATE. . <br />Mr. Moore moved for adoption of the Resolution and Mr. Mooney <br />seconded the motion. Staff advised Council Saucedo's was the low <br />bid, and they had one bad reference in the reference check and the <br />trucks were not in good condition when inspected. Celestino Mendez, <br />representing Saucedo's, advised Saucedo's bid was considerably lower <br />than other bids received and the Council should re-examine the bids. <br />He stated there would be considerable savings if the award was to <br />Saucedo's and this would affect Saucedo's business. Jesse Saucedo <br />stated Thomas Trucking, Inc. lease their trucks and Saucedo's own <br />their own trucks and have their own'mechanics. He stated the <br />contract does not prohibit the work from being subletted. They want <br />a fair shot at this bid and their trucks are capable of doing the <br />work. Mr. Cox stated he thought if one bad reference kept a bidder <br />from being awarded bid, it should be a written policy. Mr. Gilley <br />stated it is simply a Staff recommendation and that Council <br />ultimately decides who to award bid to. Mr. Cox asked if Mr. <br />Saucedo's trucks were a safety issue, and Mr. Gilley stated they are <br />a safety issue in that the inspection revealed worn tires and <br />leaking hydraulic systems. The Council expressed concern for the <br />inconsistencies between bidders. If subletting is allowed, the City <br />has no way of knowing who the actual work will be performed by when <br />award is made. Mr. Hart stated the main issues are if delivery can <br />be timely made and the cost of delivery and is not concerned with <br />who makes the delivery. On roll call the following vote was <br />recorded: <br /> AYE: Mooney, Cox, Plummer. <br /> NAY: Moore, Hart, Morris, Guerra. <br />ABSTAIN: None. <br />The motion for adoption of the Resolution failed. Mr. Moore moved <br />to amend the Resolution to award bid to Saucedo's Construction of <br />San Marcos, Texas for Item #1 - $2.19 total price per ton, Item #2 - <br />$26.90 per hour for hot mix delivered in lay down machine with one <br />day advance notice and Mr. Guerra seconded the motion. On roll call <br />the following vote was recorded: <br /> AYE: Moore, Mooney, Hart, Guerra, Cox. <br /> NAY: Morris. <br />ABSTAIN: Plummer. <br />Mayor Morris introduced for consideration Item 12.C.
