2015 -2018 Meet and Confer Agreement <br />Between the San Marcos Professional Firefighters Association and the City of San Marcos, Texas <br />B. Guidelines: <br />1. The lateral entry program is for pay purposes only and actual work experience in another fire <br />and /or EMS Agency will not be considered for promotional eligibility requirements. <br />2. The Fire Chief's determination, following review with the Association President, of whether <br />an applicant meets the criteria of the lateral entry program shall be final and non - appealable <br />to the Civil Service Commission or to any court. <br />3. If an applicant is placed up to step 19.3 of the pay schedule, he /she will progress through the <br />remaining steps as he /she completes each year of service. <br />4. Longevity pay will be calculated in the same manner as all Firefighters. No credit will be <br />given to completed years of service in other agencies. <br />5. Entry -level firefighters placed up to Step 19.3 of the pay schedule as per the lateral entry <br />program must also complete a new hire probationary period. <br />C. Statutory Preemption: <br />To the extent that any of these provisions are in conflict with the TLGC Chapter 141, 142 and 143, <br />this provision shall prevail. <br />Section 3. Eligibility List: <br />A. This article shall supersede Section 143.025 of the Texas Local Government Code to allow for more <br />than one eligibility list to be in effect at the same time which shall be utilized upon the exhaustion <br />or expiration of the prior list. <br />B. Additional points may be awarded only to an applicant for a beginning position with a passing <br />score as follows: <br />1. Two (2) years prior military experience with Honorable Discharge from the United States <br />Armed Forces 5 points; <br />or <br />2. Bachelor's Degree or greater 3 points. <br />*No cumulative points for college hours or military service are allowed such that the single <br />highest number is the maximum total point for any applicant. <br />C. The Fire Chief may consider the applicant's failure to remove his /her name from any and all other <br />fire department's eligibility list(s), and provide verification as requested, as a good and sufficient <br />reason to pass over that applicant for initial appointment to a beginning position. <br />Section 4. Preemption <br />To the extent of any conflict, the provisions of this article preempt TLGC Chapter 143 including Section <br />143.025(f), and any state statute, local ordinance, executive order, civil service provision or rule adopted <br />by the head of the Fire department or City of San Marcos or by a division or agent of the City such as a <br />personnel board or civil service commission as per TLGC Section 142.117. <br />Page 6 <br />
