9.10. Cost of Insurance. If the City chooses to arrange for any of the insurance <br />coverage outlined in this Appendix, the City may elect to obtain such insurance, <br />provided that" <br />(a) written notice is received by the Authority at least 90 days prior to the <br />Contract year during which the City will assume this responsibility or 90 <br />days prior to the expiration date of the insurance placed by the Authority; <br />(b) the City names the Authority as an Additional Insured and waives its <br />subrogation rights upon assumption of such responsibility; and <br />(c) the City pays any cancelation penalty (or short-rate) arising out of <br />canceling the Authority provided coverage required by this Appendix, <br />prior to its expiration date. <br />All remaining terms of the Plant Operating Agreement remain in full force and effect. <br />This First Amendment to Plant Operating Agreement will become effective <br />immediately upon your countersignature below. <br />Thank you for your cooperation and assistance in this matter. Please countersign both <br />originals of this First Amendment to Plant Operating Agreement, retaining one original <br />for your file and returning the other fully executed original to my office. <br />Sincerely, <br />W.E.
