C. Funding: The CITY and COUNTY, in performing governmental functions or in <br />paying for the performance of governmental functions hereunder, shall make that performance or <br />those payments from lawfully available current revenues during each fiscal year. <br />D. Liabili : Each party to this Interlocal Agreement will be responsible for its own <br />actions in providing services under this Interlocal Agreement and shall not be liable for any <br />claims, losses, expenses, demands, judgments, lawsuits or damages that may arise from the <br />furnishing of the services by the other party. Nothing in the performance of this Interlocal <br />Agreement shall impose any liability for claims against CITY or COUNTY other than claims for <br />which liability may be imposed by the Texas Tort Claims Act. <br />E. Third Parties: The Parties to this Interlocal Agreement do not intend for any <br />third party to obtain a right by virtue of this Interlocal Agreement and this Interlocal Agreement <br />shall not create any rights in any third party. <br />F. Entire Agreement: This Interlocal Agreement contains the entire agreement <br />between the Parties and supersedes all prior understandings and agreements between the Parties <br />regarding such matters. This Agreement may not be modified or amended except by written <br />agreement executed by all three Parties. None of the Parties may assign this Interlocal <br />Agreement without the written consent of the other two Parties. <br />G. Interpretation: The Parties acknowledge and confirm that this Interlocal <br />Agreement has been entered into pursuant to the authority granted under the Act. All terms and <br />conditions are to be construed and interpreted consistently with the Act. <br />H. Invalid Provisions: Should any provision in this Interlocal Agreement be found <br />or deemed to be invalid, this Interlocal Agreement will be construed as not containing the
