ORDINANCE 1993- 64 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SETTING A FEE FOR UTILITY CUSTOMER REQUESTS FOR CONFIDENTIALITY OF ACCOUNT INFORMATION; PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY. I WHEREAS, H.B.859 enacted by the 73rd Texas Legislature ! requires the city to allow city utility customers to request that certain information in their accounts be kept confidential, and allows the city to establish a fee for complying with such requests; and, WHEREAS, the City Council finds and determines that the administrative costs to the city of complying with these requests is $5.00 per customer; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION L That a fee in the amount of $5.00 is hereby set for each city utility customer request for confidentiality of account information. SECTION 2. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full I force and effect from and after its adoption and after its I publication in a newspaper of genera~ circulation within the City ! , as provided by the city Charter of the city of San Marcos. ~~ PASSED, APPROVED AND ADOPTED this 23rd d~YJ '~f A .~. t ¿1993. j~,¡,~. ü~ William Plummer, r.
