Mr. Darren Dunn asked in reference to <br />the alternate that Mr. Guerra mentioned if the Council did adopt <br />would the Council have to call a special election? Mr. Guerra <br />stated that he would like to clarify that his conversation with <br />the City Attorney was an informal one and not a legal opinion that <br />, was given to him. Mr. Guerra stated that his assessment is based <br />on the very limi ted knowledge of other case law in Texas and <br />information he has been able to obtain from the TML, and National <br />League of cities. Mr. Guerra stated that the specific question <br />that Mr. Dunn was asking are legal in nature and he would be unable <br />to answer his question and not be qualified to answer that. Mayor <br />Morris stated that they would need clarification on the information <br />that Mr. Guerra had brought to the Council from Mr. Taylor when he <br />gets back and once they get clarification on that Mr. Dunn could <br />ask those questions. <br /> <br />Mayor Morris stated that since the staff failed to place city <br />Manager's Report, City Attorney's Report and City Council's Report <br />the Council would do that. The city Manager, City Attorney and <br />City Council did not have any reports. <br />< <br />Mayor Morris introduced an Executive Session pursuant Article <br />6252-17, section 2(e), V.A.C.S., to discuss pending litigation <br />(sierra Club v. Babbitt¡ Gumtow vs. City of San Marcos) and matters <br />where the city Attorney's ethical duty to the city clearly <br />conflicts with Article 6252-17.
