31 <br />THE STATE OF TEXAS <br />TERMINATION OF LEASE AGREEMENT <br />COUNTY OF HAYS <br />KNOW ALL MEN BY THESE PRESENTS: <br />That the City of San Marcos, Texas, a municipal corporation <br />existing by and under the laws of the State of Texas, acting <br />through authority conferred on its Mayor, Emmie Craddock, by <br />resolution duly adopted on September 14, 1981 hereinafter "City", <br />and Crazy Morse Equipment Company, a partnership consisting of <br />Paul H. Heiser and Ronee Del Bianco, hereinafter "Crazy Horse", <br />enter into this agreement to terminate that lease of March 9, 1981, <br />of premises known as Lowman Airport, in Hays County, Texas, being <br />that real property conveyed by Robert P. Lowman to the City of <br />San Marcos by deed dated December 4, 1954, and recorded in Volume <br />163, Pages 426-430, Hays County Deed Records. <br />In consideration of the payment of fifteen thousand dollars <br />($15,000.00) by City, the following express promises by City: <br />1) that within ninety days of the execution of <br />this Agreement, said premises known as Lowman <br />Airport shall be offered by City for sale by <br />request for submission of sealed bids; <br />2) that one condition of said offer for sale shall <br />be the requirement that said premises shall be <br />maintained as an airport open to the general <br />public until September 30, 1982; and <br />3) that one condition of said offer for sale shall <br />be the requirement that, for so long as said <br />premises are maintained as an airport, adjacent <br />property owners shall be allowed access to the <br />premises at no charge to the adjacent property <br />owner; <br />and the mutual agreements and benefits to be obtained by both <br />parties, it is expressly agreed by City and Crazy Horse that the <br />lease of said real property conveyed by Lowman to City by deed <br />dated December 4, 1954, for the express use of providing runways <br />at said field, shall be terminated as to the rights, duties and <br />obligations of both parties when sale of said premises known as <br />Lowman Airport by City is completed, the purchaser has taken <br />possession of the property and the deed has been filed in the <br />Hays County Deed Records.
