-4- <br />in the minimum limits of one hundred thousand dollars ($100,000.00) <br /> per person and three hundred thousand dollars ($300,000.00) for any <br /> single occurrence of bodily injury or death and one hundred thousand <br /> dollars ($100,000.00) for any single occurrence for injury to or <br />destruction of property. Said insurance policy shall name City as <br /> co-insured. Said insurance policy shall contain the endorsement that <br /> such insurance shall not be cancelled or amended with respect to <br /> Foundation without ten (10) days written notice by certified mail, <br /> return receipt requested, to City by the insurance company. City <br /> shall not be required to pay any premiums on said policies. Any <br /> policy herein required or procured by Foundation shall contain an <br /> express waiver of any rights of subrogation by the insurance company <br /> against City. The minimum limits of any insurance coverage herein <br /> required shall not limit Foundation's liability under Part VII of this <br />Agreement. <br />IX. <br />Foundation, the by execution of this Agreement, gives its <br />permission to City to enter upon the premises of the Gary Job Corps <br />Center to perform the services described in this Agreement. <br />X. <br />Foundation, by execution of this Agreement, warrants that it has <br />proper legal authority to prohibit the unsupervised running at large <br />of dogs on the premises of the Gary Job Corps Center. <br />XI. <br />This Agreement may be terminated by either party by the giving of <br />ten (10) days written notice of the intent to terminate at the end of <br />which time the Agreement shall be considered terminated for all <br />purposes. <br />XII. <br />Foundation shall not assign any of its rights or responsibilities <br />under the terms of this Agreement without first obtaining the prior
