40 i?ESuLU`iluiv iNQ. 1961-,62R l_J A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A PLAT OF SEC- TION BB OF THE MCGEHEE ADDITION TO THE SAN MARCOS CEMETERY; AUTHORIZING THE MAYOR OF SAID CITY TO SIGN THE CERTIFICATE OF APPROVAL OF SAID PLAT; AUTHORIZING PAYMENT TO CHARLES R. SWART FOR SERVICES RENDERED PURSUANT TO THE TERMS AND CONDITIONS OF THE PROFESSIONAL SER- VICES AGREEMENT FOR THE SURVEYING AND STAKING OF A PORTION OF THE SAN MARCOS CEMETERY ENTERED INTO BY SAID CITY AND CHARLES R. SWART ON MAY 11, 1981 AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, by resolution duly adopted May 11, 1981, approved an agreement which engaged the services of Charles R. Swart for the surveying and staking of a portion of the San Marcos Cemetery; and, WHEREAS, said City Council, by resolution enacted September 14, 1981, approved the Plat of The 1981 Rearrangement of Sections 2, 3, 4 of the Dixon Addition to the San Marcos Cemetery and authorized the Mayor of said City to sign the certificate of approval for said plat; and, WHEREAS, Charles R. Swart has presented to said City Council a plat of section BB of the McGehee Addition to the San Marcos Cemetery; and, WHEREAS, said City Council hereby finds and determines that Charles R. Swart has completed those services assigned to him by the Professional Services Agreement For The Surveying And Staking Of A Portion Of The San Marcos Cemetery entered into by said City and Charles R. Swart on May 11, 1981, in substantial compliance with the terms and conditions of said Agreement; and, WHEREAS, the City of San Marcos has received a statement from Charles R. Swart in the amount of $4650.00 for services provided pursuant to said Agreement, said amount being $2433.00 for basic services and $2217.00 for additional services; and, WHEREAS, $4650.00 has been appropriated in the 1980-81 budget in budget line item 10-10-5216 for professional services for the cemetery; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Plat of Section BB Of The McGehee Addition To The Cemetery Of The City Of San Marcos, Hays County, Texas, prepared by Charles R. Swart, Public Surveyor, pursuant to the terms and conditions of the Professional Services Agreement For The Surveying And Staking Of A Portion of the San Marcos Cemetery entered into by said City and Charles R. Swart on May 11, 1981, a copy of which Plat is attached hereto and incorporated herein for all intents and purposes, be, and the same is hereby, approved in all respects. PART 2. That the Mayor of the City of San Marcos, Texas, Emmie Craddock, be, and she is hereby, authorized to sign the certificate of approval of said Plat, certifying to the approval of the City Council. PART 3. That payment to Charles R. Swart from line item 10-10-5216 in the 1980-1981 City of San Marcos budget is here- by authorized in the amount of $4650.00 for services rendered pursuant to that Agreement for surveying services at the San
