At?R..g 7...c?'.;M <br />ORDINANCE NO. 1981-76 <br />AUis 4. 1 1981 <br />CITY J__CF FT_ARY <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF City OF Sari Marcos <br />MARCOS, TEXAS, GRANTING TO ARMADILLO EXPRESS A <br />FRANCHISE FOR FIVE (5) YEARS TO OPERATE AND MAIN- <br />TAIN A VEHICLE FOR THE TRANSPORTATION OF PERSONS AND <br />PROPERTY UPON THE PUBLIC STREETS AND HIGHWAYS OF THE <br />CITY OF SAN MARCOS TO AND FROM POINTS OUTSIDE SAID <br />CITY PURSUANT TO THE PROVISIONS OF THE CONSTITUTION OF <br />AND LAWS OF THE STATE OF TEXAS, THE CHARTER AND CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS; SETTING TERMS AND <br />CONDITIONS FOR SAID TRANSPORTATION ENTERPRISE AND DECLAR- <br />ING AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That a franchise is hereby granted to Armadillo Express <br />pursuant to Article XI of the Charter of the City of San Marcos, as follows: <br />A. Definitions: As used in this Ordinance the following <br />words and phrases shall have the meaning ascribed to them <br />in this section: <br />(1) "City" shall mean the City of San Marcos, a municipal <br />corporation operating by and under the laws of the <br />State of Texas, situated in Hays County, Texas; the <br />words "in the City" or any similar reference to the <br />territorial limits of the City of San Marcos, Texas, <br />shall mean the area within the corporate limits of <br />the City of San Marcos as they now exist or as they may <br />hereafter be lawfully modified or extended, and such <br />areas adjacent thereto which may be lawfully served by <br />Armadillo Express. <br />(2) "Company" as used herein, unless the context clearly <br />indicates otherwise, shall mean Armadillo Express, a <br />partnership consisting of Mike McIntire and Melinda <br />A. McIntire, or its legally determined successors and <br />assigns as approved by the San Marcos City Council. <br />B. Nature and Extent of Grant: For and in consideration of <br />Company equipping, maintaining and operating a service for <br />the transportation of persons to and from Wimberly, Texas, <br />from and to points within the corporate limits of the City <br />of San Marcos, and to and from points within said corporate <br />limits from and to airports located in Austin and San Antonio, <br />City grants to Company the right and authority to operate <br />and maintain a vehicle, to-wit: one 8-passenger van, upon <br />the public streets and highways of the City of San Marcos, <br />Texas, for a term of five (5) years from the effective date <br />of this franchise. <br />Company shall file with City any routes which shall be <br />utilized by it at least ten (10) days prior to the initia- <br />tion of the usage. All routes shall be subject to the <br />approval of the Director of Public Safety for the City of <br />San Marcos. <br />C. Equipment: The vehicle of the Company shall be properly <br />maintained and operated only when in a safe, dependable and <br />sanitary condition. The vehicle shall be driven and operated <br />in accordance with all motor vehicle laws of the State of <br />Texas. <br />D. Payment to City: The City shall not require of the Company
