66 RESOLUTION NO. 1981-68R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A PIPE LINE LICENSE TO BE GRANTED TO CITY BY MISSOURI-KANSAS-TEXAS RAILROAD COMPANY; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID LICENSE; AUTHORIZING THE PAYMENT OF ONE HUNDRED FIFTY DOLLARS ($150.00) AS A HANDLING CHARGE TO SAID RAILROAD COMPANY AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, has a present need to cross property owned by the Missouri-Kansas-Texas Railroad Company, said property located in the vicinity of the intersection of Guadalupe Street and the Missouri-Kansas-Texas Railroad tracks in said City; and, WHEREAS, said City intends to construct and install by boring one line of twenty-four inch (24") pipe across or along said Railroad'Company's property for the purpose of carrying storm water; and, WHEREAS, the location of said boring is more particularly described as follows: Said twenty-four (24") inch storm sewer pipe line crosses said Railroad Company's premises at an an- gle of 66 degrees, more or less, measured to the left, southerly, tangent to curve from the center- line of said Railroad Company's San Antonio Subdivi- sion main track at Mile Post M-986.63, being main track valuation chaining station 2777+92.3, distant 21.8 feet, moreor less, measured southwesterly along the centerline of said main track from the centerline of Guadalupe Street. (DOT No. 415 511 ;l) at chaining station 2777+70.5. Said pipe line is within the limits of a public crossing; and, WHEREAS, the City Council of said city wishes to obtain a pipe line license from said Railroad Company so that said City may have the right to cross said property; and, WHEREAS, said Railroad Company, for and in consideration of the payment of a handling fee in the amount of One Hundred Fifty Dollars ($150.00) and the agreement to certain terms and conditions by City, is willing to grant the requested license; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS : PART 1. That the Pipe Line License from the Missouri-Kansas- Texas Railroad Company to the City of San Marcos, Texas, giving permission for said City to cross land owned by said Railroad Company in the vicinity of Guadalupe Street and the Missouri- Kansas-Texas Railroad tracks for the purpose of constructing and installing by boring one line of twenty-four inch (24") pipe across or along said Railroad Company's property to carry storm water, a copy of which is attached hereto and incorporated here- in for all intents and purposes, be, and the same is hereby, approved in all respects. PART 2. That the Mayor of the City of San Marcos, Texas, Emmie Craddock, be, and she is hereby, authorized to execute said Pipe Line License on behalf of said City. PART 3. That the Finance Unit of said City be authorized to pay One Hundred Fifty Dollars ($150.00) to the Missouri-Kansas- Texas Railroad Company for a handling charge incident to the granting of said Pipe Line License.
