<br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND
<br /> CONDITIONS OF THE SALE OF LOTS 381, 382, 383
<br /> AND 384 IN BLOCK FIFTEEN (15) OF THE WESTOVER
<br /> ADDITION TO THE CITY OF SAN MARCOS, TEXAS, TO
<br />c) O SCHEIB OPPORTUNITY CENTER, INC.; AUTHORIZING
<br /> >1 THE MAYOR TO EXECUTE A SPECIAL WARRANTY DEED
<br /> CONVEYING SAID PROPERTY AND DECLARING AN
<br /> () O EMERGENCY.
<br />WHEREAS, the City of San Marcos, Texas, is the owner of
<br />certain real property in said city, to-wit:
<br />All of Lots Three Hundred Eighty-One (381), Three
<br />Hundred Eighty-Two (382), Three Hundred Eighty
<br />Three (383) and Three Hundred Eighty Four (384)
<br />in Block Fifteen (15) of the Westover Addition
<br />in the City of San Marcos, Hays County, Texas,
<br />according to the map or plat thereof recorded
<br />in Volume 59, Page 184, Hays County Deed Records;
<br />and,
<br />WHEREAS, said City desires to convey said property to Scheib
<br />Opportunity Center, Inc., (hereinafter "Scheib") a non=profit
<br />Texas corporation, for the construction and maintenance by Scheib
<br />of a workshop for mentally retarded clients of Scheib and for
<br />no other use; and,
<br />WHEREAS, said City and Scheib wish to enter into a Contract
<br />for Sale concerning said conveyance, which Contract shall specify
<br />that said property is to be used only as a site for a workshop
<br />for mentally retarded clients of Scheib; and,
<br />WHEREAS, pursuant to the requirement of Article 5421c-12(4),
<br />Texas Revised Civil Statutes, which governs the sale or trade of
<br />land by a political subdivision,said City has had said property
<br />appraised; and,
<br />WHEREAS, the appraised value of said property has been
<br />found to be Twenty Thousand Dollars ($20,000.00); now, there-
<br />fore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, pursuant to Section 2(e) of Article
<br />5421c-12, Texas Revised Civil Statutes, of all of Lots Three
<br />Hundred Eighty-One (381), Three Hundred Eighty-Two (382), Three
<br />Hundred Eighty-Three (383) and Three Hundred Eighty Four (384)
<br />in Block Number Fifteen (15)(of the Westover Addition in the
<br />City of San Marcos, Hays County, Texas according to the map
<br />or plat thereof recorded in Volume 59, Page 184, Hays County
<br />Deed Records, are hereby approved.
<br />SECTION 2. That the consideration to be paid by Scheib
<br />Opportunity Center, Inc.,in the amount of Twenty Thousand
<br />Dollars ($20,000.00),said amount being the fair market value of
<br />said property as determined by an appraisal obtained by the
<br />City of San Marcos, is hereby approved.
<br />SECTION 3. That the Mayor of the City of San Marcos, Emmie
<br />Craddock, be, and she is hereby,authorized to execute a special
<br />warranty deed from said City to Scheib Opportunity Center, Inc.,
<br />which deed shall contain a covenant that said property is to be
<br />used only for a workshop for mentally retarded clients of Scheib.
