ORDINANCE NO. 1.981-84 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING CHAPTER 27, <br />` ENTITLED "TAXICABS" OF THE CODE OF ORDINANCES, <br />CITY OF SAN MARCOS, TEXAS, TO DEFINE TERMS; <br />TO REQUIRE A CERTIFICATE OF PUBLIC CONVENIENCE <br />AND NECESSITY FOR PERSONS WISHING TO OPERATE A <br />0 TAXICAB BUSINESS IN SAID CITY; TO SET STANDARDS <br />FOR THE ISSUANCE OF SAID CERTIFICATES; TO SET <br />FEES; TO PROVIDE STANDARDS FOR THE SUSPENSION <br />AND REVOCATION OF SAID CERTIFICATES; TO REQUIRE <br />TAXICAB DRIVERS' PERMITS; TO REQUIRE DISPLAY OF <br />SAID PERMIT; TO REQUIRE INSPECTION OF TAXICABS; <br />TO REQUIRE FILING OF RATES OF FARE AND THE DISPLAY <br />OF RATE CARDS; TO SET STANDARDS FOR THE PROVISION <br />OF SAID SERVICE TO PASSENGERS; TO REQUIRE THE <br />KEEPING OF MANIFESTS; TO REQUIRE THE KEEPING OF <br />CERTAIN RECORDS AND REPORTS; TO DESIGNATE AN <br />ENFORCEMENT BODY; TO SET A PENALTY; TO PROVIDE <br />FOR SEPARABILITY; TO PROVIDE FOR REPEAL OF CON- <br />FLICTING ORDINANCES AND DECLARING AN EMERGENCY. <br />106 <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Chapter 27, Entitled "Taxicabs" of the Code <br />of Ordinances, City of San Marcos, Texas, is hereby amended to <br />read as follows: <br />Chapter 27 <br />Taxicabs <br />Sec. 27-1. Definitions. <br />The following words and phrases when used in this or" <br />dinance have the meanings as set out herein: <br />(1) Certificate means a certificate of public conve- <br />nience and necessity authorizing the holder there- <br />of to conduct a taxicab business in the City of <br />San Marcos, Texas. <br />(2) Holder means a person to whom a certificate of <br />public convenience and necessity has been issued. <br />(3) Manifest means a daily record prepared by a taxi- <br />cab driver of all trips made by said driver showing <br />time and place of origin, destination, number of <br />passengers, and the amount of fare of each trip. <br />(4) Person includes an individual, a corporation or <br />other legal entity, a partnership, and any un- <br />incorporated association. <br />(5) Rate card means a card for display in each taxi- <br />cab which contains the rates of fare then in force. <br />(6) Taxicab means a motor vehicle regularly engaged in <br />the business of carrying passengers for hire, and <br />not operated on a fixed route. <br />(7) Taxicab business means a service consisting of the <br />provision and operation of motor vehicles which <br />carry passengers for hire and are not operated on <br />a fixed route. <br />Sec. 27-2.
