is hereby given the authority and is instructed to <br />observe the conduct of holders and drivers operating <br />under this ordinance. Upon discovering a violation <br />of the provisions of this ordinance, the department <br />of public safety shall report the same to the office <br />of the city attorney who shall take appropriate action. <br />Sec. 27-28. Penalty. <br />Any person violating any of the provisions of this or- <br />dinance shall be deemed guilty of a misdemeanor and upon <br />conviction thereof shall be fined an amount not exceeding <br />two hundred dollars ($200.00). Each day that such viola- <br />tion continues shall be a separate offense. Prosecution <br />or conviction under this provision shall never be a bar <br />to any other remedy or relief for violation of this or- <br />dinance. <br />Sec. 27-29. Separability clause. <br />If any section, subsection, sentence, clause, phrase or <br />portion of this ordinance is for any reason held invalid <br />or unconstitutional by any court of competent jurisdiction, <br />such portion shall be deemed a separate, distinct and <br />independent provision and such holding shall not affect the <br />validity of the remaining portions thereof. <br />Sec. 27-30. Repealing provision. <br />All ordinances or parts of ordinances in conflict with <br />this ordinance are hereby repealed. <br />SECTION 2. That the importance of this ordinance creates an <br />emergency and an imperative purpose necessary that the provisions <br />of the charter requiring that ordinances shall be read at three <br />separate meetings and that no ordinance shall become effective <br />until the expiration of ten (10) days following the date of its <br />final passage be suspended, and these provisions are hereby <br />suspended, and this ordinance shall take effect and be in full <br />force and effect from and after its adoption and publication in <br />a newspaper of general circulation within the City. <br />PASSED, APPROVED, AND ADOPTED this23rd day of November , 1981. <br />Berry James <br />Mayor Pro-Tem <br />Attest: <br />Janis K.
