SALE OF ONLY SOUND, PROPERLY LABELED FOOD, TO. <br />TO ESTABLISH SAN ION <br />REGULATE THE SOURCE OF FOOD <br />? ; <br /> ;j STANDARDS FOR FOOD, FOOD PROTECTION, FOOD SE?,Y):< <br />FOOD <br />FOOD SERVICE OPERATIONS <br />VICE PERSONNEL <br />E? <br /> , <br />, <br />F--i EQUIPMENT AND UTENSILS, SANITARY FACILITIES AND <br /> CD <br />o O CONTROLS AND OTHER FACILITIES; TO REQUIRE PERMITS <br /> <br />a FOR THE OPERATION OF FOOD SERVICE ESTABLISHMENTS; <br /> TO REGULATE THE INSPECTION OF SUCH ESTABLISHMENTS; <br /> U TO PROVIDE FOR THE EXAMINATION AND CONDEMNATION <br />Q OF FOOD; TO PROVIDE FOR ENFORCEMENT AND TO SET <br />PENALTIES AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the protection and promotion of public health and <br />sanitation is an important and far-reaching function of municipal <br />government; and, <br />WHEREAS, the City of San Marcos, Texas, as a municipal <br />corporation existing by and through the laws of the State of Texas, <br />has the power and the duty to promote public health and improve <br />sanitation for the residents of the City of San Marcos, Texas; <br />and, <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />hereby finds and determines that the following regulations <br />pertaining to food and food establishments within the corporate <br />limits of the City of San Marcos, Texas, are necessary for the <br />preservation and protection of the health and sanitation of the <br />residents of said City; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Chapter 11, Entitled "Food and Food Establish- <br />ments," of the Code of Ordinances, City of San Marcos, Texas, is <br />hereby amended to read as follows: <br />Chapter 1"1" <br />Food And Food Establishments <br />Sec. 11-1. Purpose. <br />The purpose of these regulations is to protect <br />the public health by establishing uniform require- <br />ments for food service operations. <br />Sec. 11-2. Definitions. <br />The following definitions shall apply in the <br />interpretation and the enforcement of this ordinance: <br />(a) "Commissary" means a catering establishment, <br />restaurant, or any other place in which food, <br />containers, or supplies are kept, handled, <br />prepared, packaged or stored. <br />(b) "Corrosion-resistant materials" means those <br />materials that maintain their original surface <br />characteristics under prolonged influence of <br />the food to be contacted, the normal use of <br />cleaning compounds and bactericidal solutions, <br />and other conditions-of-use environment.
