4.a <br />1 <br />?l <br />t-- <br />c <br />U) <br />CY O <br />(?,S <br />?i <br />C <br />a 4?? <br />UU <br />129 <br />ORDINANCE NO. 1981-95 <br />AN ORDINANCE ESTABLISHING A PROGRAM OF COMPREHEN- <br />SIVE EMERGENCY MANAGEMENT WHICH INCLUDES THE MITIGA- <br />TION, PREPAREDNESS RESPONSE AND RECOVERY PHASES OF <br />CIVIL PREPAREDNESS; CREATING THE OFFICE OF EMERGENCY <br />MANAGEMENT DIRECTOR; CREATING THE POSITION OF EMER- <br />GENCY MANAGEMENT COORDINATOR; AUTHORIZING THE APPOINT- <br />MENT OF AN EMERGENCY MANAGEMENT COORDINATOR; PROVIDING <br />THE DUTIES AND RESPONSIBILITIES OF SAID OFFICES; IDEN- <br />TIFYING AN OPERATIONAL ORGANIZATION; GRANTING NECESSARY <br />POWERS TO COPE WITH ALL PHASES OF EMERGENCY MANAGEMENT <br />WHICH THREATEN LIFE AND PROPERTY IN THE CITY OF SAN <br />MARCOS, TEXAS; AUTHORIZING COOPERATIVE AND MUTUAL AID <br />AGREEMENTS FOR RELIEF WORK BETWEEN THIS AND OTHER CITIES <br />OR COUNTIES AND FOR RELATED PURPOSES; PROHIBITING UN- <br />AUTHORIZED WARNING AND ALL-CLEAR SIGNALS; MAKING VIOLA- <br />TIONS A MISDEMEANOR PUNISHABLE BY FINE NOT TO EXCEED <br />$200.00; PROVIDING FOR SEPARABILITY AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />hereby finds and determines that the identification of potential <br />hazards and the prevention or mitigation of their effects must be <br />an on-going concern of the City if the lives and property of the <br />populace are to be protected; and, <br />WHEREAS, the City Council hereby declares that the preparation <br />of a plan, and the means for its implementation, for the protection <br />of lives and property in the City of San Marcos, Texas, from natural <br />or man-caused disasters or threat thereof is immediately essential; <br />and, <br />WHEREAS, the City Council further finds that in times of disas- <br />ters which may imperil the safety of the inhabitants of the City, <br />or their property, it becomes necessary to effectuate and place in- <br />to operation the preconceived plans and preparations with a minimum <br />of delay; and, <br />WHEREAS, the City Council hereby finds and determines that the <br />preparation, adoption, and implementation of such plans are now <br />imperative; now, therefore, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANT MARCOS, <br />TEXAS: <br />SECTION 1. That Chapter 7, entitled, "Civil Defense and Disas- <br />ter Relief," of the Code of Ordinances, City of San Marcos, Texas, <br />is hereby amended to read as follows: <br />Chapter 7 <br />Emergency Management <br /> <br />(a) The office of emergency management coordinator is <br />hereby created. The emergency management coor- <br />dinator shall serve at the pleasure of the director; <br />(b) The director shall be responsible for conducting a <br />program of comprehensive emergency management within <br />the city and for carrying out the duties and responsibil- <br />ities set forth in Sec. 7-4 of this ordinance. The <br />director may delegate authority for execution of these <br />duties to the coordinator, but ultimate responsibility <br />for such execution shall remain with the director. <br />Sec. 7-1. Emergency management director-office created; <br />mayor to serve. <br />There is hereby created the office of emergency manage- <br />ment director of the City of San Marcos, Texas, which <br />shall be held by the mayor in accordance with state law.
