119 Regular Meeting May 10, 1993 Page 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, GENERAL OBLIGATION REFUNDING BONDS, SERIES 1993; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; CALLING CERTAIN OBLIGATIONS OF THE CITY FOR REDEMPTION PRIOR TO MATURITY; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Hart seconded the motion. Mayor Morris moved to amend the Ordinance and read into the record amendments provided by Mr. Rick Fisher (attached) and Mr. Moore seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Ordinance on emergency. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, ELECTRIC UTILITY SYSTEM REVENUE REFUNDING BONDS, 'SERIES 1993, IN THE AGGREGATE PRINCIPAL AMOUNT OF $lð,645,000*, PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; CALLING CERTAIN OBLIGATIONS OF THE CITY FOR REDEMPTION PRIOR TO MATURITY; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded the motion. Mayor Morris moved to amend the Ordinance and the City Secretary read into the record amendments provided by Mr. Rick Fisher (attached) and Mr. Hernandez seconded the motion, which passed unanimously~ The Council then voted unanimously for adoption of the Ordinance on emergency. Mr. Rick Fisher advised the Council an additional amendment was needed in Item 6.A., the Ordinance regarding refunding General Obligation Bonds. Mayor Morris moved to reconsider the Ordinance and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for reconsideration adoption of the Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, GENERAL OBLIGATION REFUNDING BONDS, SERIES 1993; PRESCRIBING THE FORM OF SAIDS BONDS; PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; CALLING CERTAIN OBLIGATIONS OF THE CITY FOR REDEMPTION PRIOR TO MATURITY; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. Mr. Plummer moved to amend section 7.01 on Page 25 to read identical as appeared in the Ordinance and to adopt the Ordinance on emergency and Mayor Morris seconded the motion. On roll call the following vote was recorded: AYE: Moore, Hernandez, Hart, Morris, Cox, Plummer. NAY: Guerra. ABSTAIN: None. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held April 26, 1993 and Special Meeting held May 3, 1993, approval of four Ordinances on second reading, adoption of two Ordinances on third and final reading, adoption of ten Resolutions and approval of the Comprehensive Annual Financial Report for the year ended September 30, 1992 on consensus.
