123 Regular Meeting May 10, 1993 Page 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF LEASE AMENDMENT NUMBER TWO TO A LEASE BETWEEN THE CITY AND SOUTHWEST TEXAS AVIATION, INC. FOR AIRPORT PROPERTY AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE C~TY; AND DECLARING AN EFFECTIVE DATE. Mr. Plummer moved for adoption of the Resolution and Mr. Hart seconded the motion. Mayor Morris moved to amend the Lease in section 3. Consideration, as fol1ows: " The LESSEE agrees . . . . to pay to the LESSOR an annual fee equal to 1% of the gross revenues of all of LESSEE'S commercial operations at or using the facilities of the San Marcos Municipal Airport. . .," and Mr. Plummer seconded the motion. Mayor Morris stated she was willing to amend and adopt the Lease now, because it would be detrimental to Mr. Stallings' business if the city did not proceed now. The Council voted unanimously for approval of the amendment. The Council then voted unanimously for adoption of the Resolution. Mayor Morris introduced an Executive Session pursuant to Article 6252-17, sections 2(e) and (f), V.A.C.S., to discuss pending litigation (Sierra Club vs. Babbitt) and matters where the city Attorney's ethical duty to the City clearly conflicts with Article 6252-17; value of real property and negotiated contracts for prospective gifts or donations to the city, respectively. Mr. Guerra moved to adjourn into Executive Session at 10:10 p.m. and Mr. Hernandez seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene at 11:12 p.m. and Mr. Guerra seconded the motion, which passed unanimously.
